ParkingEye POPLA Appeal Help - I paid and have evidence

Hi,

Looking for a bit of advice on how best to approach a POPLA appeal. Quick summary : 

I parked at the Champion Business Park car park, which is managed by ParkingEye. There is a sign which says :

90 minute free stay
Tariffs apply thereafter
Up to 1 hour £3:00
Up to 2 hours £5.00
All tariffs include the first 90 minutes free

The only option on the sign is to use PayByPhone - either the app or the phone.

I parked, and was there for 1 hour 55 minutes. At about 85 minutes in, I realised I was going to go over the free 90 minutes, so I bought an extra hour through the app. All my details are correct, and I have evidence from the app, plus an emailed receipt. I bought the extra hour before the 90 minutes was up, even though the app says I can pay any time up to 11:59pm on the day of parking. So - as far as I can tell - I've done exactly what they asked, I've paid for my parking and I have evidence. I've done this once every week for the last four weeks.

I got a Parking Charge Notice which related to the second time I did it, which states that I have exceeded the free 90 minute period. I appealed it via the ParkingEye website, uploading my evidence - their signage, a screenshot of my parking history in PayByPhone and a copy of the email receipt (all of which have my reg in there, and the date, time and parking location specified), assuming this would just be an error - but I have just received a rejected appeal notice. All they say is "We have reviewed the details outlined in your appeal, but we are not in receipt of sufficient evidence to confirm that the terms and conditions were not breached. Our
records confirm that no parking was purchased on the date of the parking event, despite
there being payment methods available." This seems like a fob off - almost as though they haven't bothered to look at the evidence I've provided.

I also got a Parking Charge Notice for the third time I did it, which I have appealed, but have not had a response to that yet. What's weird is that they haven't sent a charge for the first time I did it - so I have bought parking in exactly the same way four times, and they have issues a Charge Notice for the second and third times, not the first - so not only are they wrong, they are inconsistent!

So I now need to write a POPLA appeal. I've looked at a lot of POPLA appeals on here which are extremely long and complex, but my case seems pretty straightforward - you're saying I haven't paid, but I have, here's my receipts showing that I paid - what else is there to say? If I haven't bought my parking "in the right way", then their signage is inadequate, but as far as I can tell I've done everything right - but they obviously don't agree!

Any advice appreciated - I am fully expecting ParkingEye to reject the appeal for the third week, and I wouldn't be surprised to get a Charge Notice for the fourth week as well, so I could end up with three Charge Notices for three separate days when I have actually paid for parking!

  • Why do you keep parking in the scammers web?

    In your POPLA appeal, you need to have as many points as possible. You only need to win on one whereas the PPC has to win on them all.

    So, you include as many as possible points in your POLA appeal. If you lose the appeals, don't worry and come back if you ever get a claim.

    There's far too much use of the word 'I' in your post.
    In your appeal(s) did you also tell ParkingEye who was driving?
  •  I am not going to be parking there any more!! I didn't explicitly tell them who was driving, but I may have used some language that infers it was me. I genuinely just assumed it was a mistake on their part - I cannot see what I've done wrong, and I've no idea why they've rejected the appeal - I have paid, I've got my receipts to prove it - what's the problem?!

    Point taken about having as many points as possible.
