when does an unclaimed return legally become mine to dispose of?

I bought an item (under £100) but it was cosmetically damaged although still usable. After several weeks of terrible communication and evasion from seller I received a refund and buyer said they would send a returns label which 6 weeks on hasn't happened. I have reminded them. How long before I can legally dispose of item?

You need to give them written notice that if they don't collect it within a certain time frame you will sell the goods.
If you do sell them you need to get a reasonable price for them, and the proceeds of sale belong to the seller - although you can keep your reasonable selling expenses.
