A lesson for everyone. Always let your own insurance company deal with any relevant issues. They should be your first port of call.
A third party insurance are only getting involved as they can control costs. Your next insurance premium will increase either way.

Going via the TP can work in your favour, especially if you insist on using your own garage. Then you get to say when the repair is complete and the loan car goes back.And at any time you can always just go to your own insurer if you don't like their attitude.0

That would risk it being a fault claim... TPI will say they have already provided indemnity and so refuse settlement. Your insurers would struggle to claim to have a right to claim against the first garage given neither the insured not the insurer were in contract with them[Deleted User] said:In that case the threat of going to your own insurance is probably the best bargaining chip you have.0 -
Hello everyone! Thanks for all your advice! Bit of a update! 3rd party insurance finally provided a final response letter and offered £50 as an appolgie.... given the drama I think I'm getting fobbed off...however be it accidentally or what in there final response they have given me a right to refer to the fincial ombudsman, who when I spoke to them stated its very rare however will take on the case given the right to refer1

Hello All
Its been awhile ! bit of an update and not a good one , after being referd to the fincial ombudsman they have now backtracked and the ombudsman has withdrawn and stated not in there remit!
So back to square one, My last and only option is small claims court to try and obtain the fee for the service of the car! (£350) if i am to to loose at small claims am i liable for the other sides costs?0
