Is a PCP covered under Section 75

I understand that under the Section 75 law, if I buy something costing £100.01 to £30,000 and pay for any of it, even a penny, on a credit card, then the card firm is jointly liable with the retailer for the WHOLE amount. My question is if I pay say £1,000 with a credit card and £10,000 from my part exchange of my existing car and purchase a car on a PCP, would I be covered by Section 75 if the car had a major problem and the seller refused to repair it at no cost?

  • S75 is not an insurance policy nor is it a warranty.

    What makes you think that it would cover a repair at no cost to you.

    I understand that if the dealer misled you about the condition of the car you may have a claim.

    Only if its a breach of contract... so this will depend on the age of the vehicle, if its reasonable or not considering its age and things like if you've followed reasonable maintenance etc.

    In principle you'd have S75 from both the CC company and the PCP provider.

    If the car was over £30,000 but under £60,260 then you would have S75A protection from the PCP provider.

    Remember that it's the value of the car, not the amount to be paid after taking off the PX monies.
