QDR Letter Northern Ireland

Good Morning. 
I did tried to read the Newbbies Section but i ll be damned if i could understand half of it.
English is not my first lanquage and i never had any contact with the law or state agencies of sych type. 
I 've recieved a letter at 22 Sep 2023, from QDR Solicitors about a PCN from last year.

They wrote they have been instructed from ZZPS who are acting on behalf of Euro Car Parks Ltd
regarding a not purchase of valid permit and display permit.

They require me to pay 170 Pounds in 14 days and that failure to do so, "may result in us recommending to our client that we pass this matter to our Litigation Department. This may mean they will to obtain a County Court Judgment".

This will affect my status of employement as they say, affect my credit, future lending, attachment of earnings or applying for a Warrant of Execution (including a baillif).

I don't know what to do here. Am i in trouble ? 

Any advice will be much appreciated. I feel kinda overwelmed. I am totally unfamiliar with all these above....

    Just read the Northern Ireland part of the NEWBIES thread.  Reply and tell QDR that Northern Ireland doesn't have the same County Court system and nor does it have keeper liability, so "stop harassing me".

    Please show us that letter.  Cover up your name and car numberplate on the letter.

    I don't know what to do here. Am i in trouble ?

    This will not affect your "status of employment" or your credit rating or any of the above items that you are worrying about needlessly.
    You are not "in trouble". You are the victim of a scam by an ex-clamper, unregulated private parking company. You have received a speculative invoice in the hope that you are a low-hanging fruit on the gullible tree and will pay into their scam. Don't!!!

    Have you been in touch with them at all? If so, did you admit to being the driver or identify the driver at all?

    You need to understand that, they can only hold the driver liable for their speculative invoice in NI. They have contacted you as the Registered Keeper (RK). The driver and the RK are two separate legal entities.

    DO as advised by @Coupon-mad above. Email QDR as the RK and go tell them to sit on a sharp stick and rotate.

    Thats the letter Sir/Madam. I 've never communicate with them. Obviously they don' t know who was the driver as. I did understand that part from the niewbie post. If u feel right so and there is a template or something, i can send then an email. If not, i ll wright whatever i ll been told by the members here.

    No Sir/Madam. I have never made any contact and i learned in here, to never tell who the driver was.

    Its because of all these threats regarding the CCJ. I have "NIL" in my background check, no problems with the law 5 yrs n
    in NI what so ever and i don't know the leagal system and terminology here.
    I understand they write these letters in such way, but it does make me think if any of these does applies, i ll possibly go into troubles in and i dont have money for solicitors. 
  • That letter is just a debt collection letter. As advised in the Newbies thread, ignore all debt collector letters.

    Have you tried asking for advice from your Consumer Council?

    Shocking stuff. But useful to see there is no opportunity offered to dispute the 'debt'.  It is all about payment and threats.

    Debt 'resolution'? They are having a laugh.

    You could add to my suggested wording above:

    You are in breach of the FCA CONC rules in that you are not considering disputes, just demanding money and threatening my livelihood, when you/your clients actually have no intention at all to proceed in the Northern Ireland court system.  

    ZZPS are debt collectors. I suspect ZZPS sent this letter on QDR notepaper.  Do ZZPS even know about the FCA CONC rules?

    The alleged debt is disputed and denied, not least because the POFA doesn't apply.  I am not legally liable. What then, is your basis for aggressively threatening the livelihood of the registered keeper in a part of the UK where QDR has no track record of filing claims?

    You and your client (and Euro Car Parks, further back in the food chain and seemingly almost irrelevant to your/ZZPS' rabid pursuit of me) are also in breach of the BPA CoP rule 24.1d.

    The BPA requires operators wishing to recover alleged debts to abide by the FCA CONC rules. Explain yourselves.

    Further, the pre-action protocol requires a real LBC to grant 30 days to respond and there should be attached reply forms (not that ZZPS or QDR know how the NI system works, clearly).  This threatogram was sent second class and gave me 14 days (now almost expired by the time it arrived).  Money for old rope, I guess, when the parking industry and their hangers-on set out to frighten and intimidate people.

    The added £70 is an insult to anyone's intelligence and wasn't specified on ECP signage.  It never is, but you and Mr Osner (whose old firm Roxburghe lost its OFT debt collection licence for wrongful treatment of consumers) already know that.

    This is harassment and you - whether 'you' be QDR or ZZPS - and also ECP must cease and desist.
