CarFlow

I know there is a newbie forum but I think my situation is unique. 
My old car was written off the end of last year by my insurance company who then sold it to CoPart who in turn sold it onto a new owner. When I accepted the money to sell it on CoPart asked for the V5 and the keys which I sent. Now either they asked for the new keeper bit to filled out or not I don't know. In April I received a speeding notice and a letter from Carflow saying I had parked over the time... I was still the registered keeper. I have since resolved this but still got the letters and now one from DCBL saying I owe £170. I have rang CarFlow and explained. I have appealed too. What do I do now? I have asked DVLA for the new registered keepers details

    No situation is unique, you will find that someone has been there before you! Is it DCB Legal or DCB Ltd that are chasing you? What you want from DVLA is the date you transferred the car to the next Registered Keeper.

    DCB Ltd are powerless debt collectors and can safely be ignored.

    Never, ever 'phone an unregulated private parking company or any of their agents.

    Did you fill in the V5C (on paper and post it, or online) to tell the DVLA you were no longer the keeper?

    Do you have proof from the DVLA that you were not the keeper at the time of the alleged parking event?

    Do you need help with the speeding fine? If so, then go to pepipoo.com as the are the police and council motoring specialists.

    I am sure you meant to write "I have sent a copy of this to CarFlow...". Please confirm.

    Speeding fine has been sorted. Police happy that I wasn't the driver. 
    I filled out the form on the DVLA website. CoPart had my V5 and said they hadn't received it ... how did the new owner get the keys!? 

    All I am concerned about it's bailiffs turning up at my door, a court summons and a County Court Judgement. I know this all very unlikely but I am self employed and also unwell

    Before getting any of those things about which you are concerned, you have to receive a N1 claim form then go to a court hearing (having submitted a defence and witness statement), lose (which you won't with our help) and fail to pay in the timescale set by the judge.

    Bailiffs (High Court Enforcement Officers) can't turn up at your door.  There's a whole raft of processes that need to be gone through before even the most remote of possibilities of that occurring. You only get a court summons for a criminal case, this isn't one of those, it's a civil case. You only get a CCJ if you lose in court and then you have a month to pay off the cost order to expunge the CCJ from your credit records. If the cost order is below £600, even if you don't pay it (not recommended), you won't see a HCEO. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    They aren't bailiffs.

    You can't appeal to POPLA.

    Te you what would be REALLY useful on Monday:

    I am (again) kindly asking people to record their DRA call.  If no app on your phone that enables this, record the conversation (on loudspeaker), on another phone...

    Please can I have some urgent evidence of bullying. Need it for the DLUHC.

    Please spare half an hour, phone up DCB Ltd and put them on speaker, and record them on another phone.

    Almost no-one has done this but the evidence would be golden if you gather it and send it by email to the DLUHC, to prove that reasonable people are just being bullied.

    DO NOT BE TALKED INTO PAYING - AND DO NOT BE SPOOKED BY THEIR COURT THREATS - BUT DO KEEP TELLING THEM WHAT YOUR DISPUTE IS.  TELL THEM YOU ALREADY SND EVIDENCE TO THE PARKING FIRM THAT YOU SOLD THE CAR LAST YEAR.

    ASK THEM TO PLEASE "HELP RESOLVE MY DISPUTE SO I CAN AVOID COURT".

    (they will refuse...that's the whole point).

    Stay polite and record all of it (you may wish to stop recording for a few seconds , if required to give your phone number and address).

    You should definitely respond to question 4 of the Call for Evidence and attach your letters AND THE RECORDING and tell the DLUHC about what the aggressive debt firm said to you when you called to ask why the heck they think it's OK to pursue a case where the parking firm already know the keeper was not you by then, and why they have added the false £70 fee that the Government intends to ban?

    It is about creating evidence of you being reasonable, and them not.  It will help inform the Government.

    I can submit your recording (redact your name & data) if you aren't confident to do so.  But only if you do the recorded call on Monday.
