SABA railway PCN, missed 28 day window

I have just opened a "Penalty Notice By Post - Notice To Owner" which was sent to me by SABA as registered keeper of the vehicle in question. It relates to an occasion when the vehicle was parked at a railway station in the Midlands, in which I was not the driver of the vehicle nor present on the day.

I have read the newbies thread, but there is a slight complication which is that the 28 day period from the notice has (just) expired and I have only just today opened it. This happened because, it seems, I had neglected to notify DVLA of the change of address on the V5C when we moved house earlier this year (though I had done my licence!). Given that the Royal Mail appears to be falling apart at the moment, it took too long for the mail to be forwarded from our old address. 

The vehicle was in fact parked legally on the day. The driver did not pay for parking, but displayed their blue badge, and registered for a separate "blue badge" permit with SABA which is a ridiculous extra step that they apparently require. Presumably SABA failed to notice they had done this. 

What, if anything, should I do here. I have now updated my vehicle details with DVLA, but presumably any further correspondence with SABA or their heavies will be sent to my old address and then eventually forwarded to me. (I'll have to extent the mail forwarding contract if I need to ensure this happens for a six month period, though).

    Just appeal anyway.  Most BPA members add a few days for service.

    Start by correcting your postal address and tell SABA to erase the old one immediately as you cannot be quickly reached by an old address you no longer reside at.  Then (as registered keeper) state this as your appeal:

    The vehicle was in fact parked legally on the day.     If you CANNOT appeal, use their COMPLAINTS page instead.

  • Thanks for the reply. I can't appeal online at the address given in the PN - it just doesn't come up as an option and presumably is automatically hidden after the deadline. So do you think my best bet at this point is to send a postal appeal letter ASAP and just make no mention of the date issue? 

    Having done this, given that it was on railway land, is the current advice still that I should then ignore everything else for 6 months, as per the 2018 thread?

    Just don't reveal the identity of the driver. You are appealing as the RK, especially as you say it is a PenaltyCN

    Did you try the option to pay a Penalty Charge Notice or a Parking Charge Notice (without actually paying) to see what information they have?
  • It doesn't appear that they have any infomation. The payment link is to "paymyparkingcharge.com" and the only options are to see photos (these are just ANPR pics showing the car and numberplate closeup on arrival and leaving), and to pay. The payment link just goes straight to a payments.epqd.co.uk page to enter credit card details. 

    Yes - it is definitely a Penalty Notice not a Parking Charge Notice.

    The bit where you suggested using their "complaints" page to contact them? Sorry, from what you wrote I wasn't clear what constituted "CANNOT appeal" - indeed it seems I cannot appeal online but I can still send a letter, if as you say "most BPA members add a few days for service".  Is there a problem with doing it by post?

    As for which webpage to use to contact them - I'm not sure I understand you. I might be wrong but it seems there are maybe a few different "Saba" entities. There's the one who sent my PN, who describe themselves as "Sapa Park Solutions UK Limited". The only webpage on the PN is www.paymyparkingcharge.com (no complaints page there, and seems to be owned by ZZPS). There's the site linked by B789 (parkindigo) which as above, seems to claim to not be the company who sent my PN as they refer to them in the third person. And then, on my PN - it says "Our Client (the Creditor)" is "SABA PARK SERVICES UK LIMITED". So..... who should I be "complaining" to? It seems like a structure designed to confuse!

    I am not telling you to appeal.  I am telling you to complain.

    All BPA members have a complaints page, it's mandatory and the BPA show the links in their AOS members list.
