Forgot to Update V5C and received a PCN

    Just a quick update.
    My email I sent to the DPO @ CEL regarding the erasure of the old address which is no longer in service.  the following response was received.  It seems that the response is based on a standard template:

    RESPONSE FROM REPRESENTATIONS TEAM

    We refer to your recent correspondence.

    As clearly stated on our signs, your details were obtained from the Driver & Vehicle Licensing Agency (DVLA). Regulation 27 of the Road Vehicles Regulations & Licensing Regulations 2002 requires the DVLA to release information from its register to companies that demonstrate a reasonable cause to have the information made available to them.

    We refer to your request that we remove your details from our database. In accordance with the current data protection legislation we refuse your request. We are holding and processing your personal data in order to enforce a parking contract, in accordance with our privacy policy which can be found at www.ce-service.co.uk/privacypolicy. Further details about your right to erasure and when it does and doesn't apply can be found at www.ico.org.uk/your-data-matters/your-right-to-get-your-data-deleted.

    This Parking Charge Notice has been passed on to a Debt Recovery Agent.

    All further queries, including payments, must be directed to them.

    Please follow the instruction on the correspondence you have received.

    I've not checked back, but did you give them a replacement address and ask them to replace the address they already hold with the new information? Ideally you should've also given them some proof of your new address - council tax bill for example.

    Anyone please advise if there is a time limit of when the PCN should be sent after the parking Incident have occurred by post.
    The documents sent by CEL shows that the Incident was on 18/4/2023 but the PCN was issued on the 22/05/2023.
    Shouldn't the PCN be sent within 14 days of the Incident ?

    It depends on whether they are trying to hold you as the RK liable under PoFA 2012. Was this a NtK issued by post or was it a NtD stuck on the windscreen?

    It depends on whether they are trying to hold you as the RK liable under PoFA 2012. Was this a NtK issued by post or was it a NtD stuck on the windscreen?
    This is the initial letter sent for the PCN to the address where the VRN was registered.  There was no ticket stuck on the windscreen, as ANPR is being used for the parking at the site.
    Hence, this would mean that the PCN is sent to NTK as the vehicle is registered to the keeper at that address.
    I could not appeal within the time as I had not updated the V5C and hence was not aware of the PCN had been sent.
    Basically I have received a pdf with all the details which CEL has based on the SAR request I made. ( I think )
  • Did you reveal the drivers identity at any stage? Did you say something like "I parked" or I drove"?
