Britannia Parking

I live in Scotland and have received a parking notice from Brittania Parking stating I owe them £100.. they have a photo of my car and got my licence details from the DVLA… I’m not sure how to proceed or whether I have to pay as I don’t remember noting any parking notices and I can’t remember parking where they say…. I’m not sure if this is legal or not can someone give me some advice please ?…

    If you live in Scotland you can ignore this. In Scotland, parking firms can only pursue the driver of the car, and as they don't know who that was, there's nowhere for them to go. The only person who can inform them of the driver's details is you, so say nothing and they'll never know. 

    This position is likely to change in 2024 (not retrospective), so this will mean there will be no continuing carte blanche to park as and when you like in Scotland in future. Be ready for that. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Thank you for getting back to me... Do you think I should appeal or just ignore them completely?... I have read over the template letters to appeal but I'm not sure how to proceed.. If I ignore them will I continue to receive letter?.. I already have 2 so far...

    Ignore or write and say, (literally):
    I am appealing as the registered keeper. I am under no legal obligation to reveal to you, an unregulated private parking company, the identity of the driver. You are fully aware that there is no keeper liability in Scotland.

    I advise you to cancel this PCN and desist from passing my personal details to third parties. Failure to do so will render you liable to a court claim under Article 12 of the UK GDPR and Section 168 of the Data Protection Act 2018.

    As you have now been advised of the above, any further correspondence from you or any third party you have passed my personal details on to regarding this matter, will also lead to a claim under the Protection from Harassment Act 1997.

    Almost certainly, but if you reply they will realise that someone is actually reading their drivel and will probably send letters with greater enthusiasm.

    If you ignore, all you will get is a wave of debt collector letters which are harmless, no matter how scary they try to make them seem. You ignore those.

    However, by using the wording I gave you above, you are putting them on notice that you are not some low-hanging fruit on the gullible tree and you will then have option, should you so desire, to fight back against the bottom-dwellers.

    Ignore them or send the "up yours" letter ... as long as they don't know the driver ...... let them waste their time
