Would i receive compensation

My family an I were enjoying a 9-night vacation to Turkey, after the 4th day, my health took a severe turn. I believe this illness was triggered by consuming contaminated cheese. In the days leading up to my illness, I ate plain food like chips, chicken nuggets, and pasta. However, on the 4th day, I ate a flatbread that contained cheese. Upon reflection, it became apparent that the cheese, among other ingredients, had been left outside in the heat without any cover, exposing it to potential contaminants like insects and the adverse effects of dairy being left out in the heat. I am certain that this is where my illness began, shortly after I started experiencing symptoms, including a fever, vomiting, and fatigue.

 

The days that followed were undoubtedly the worst and most terrifying days of my life thus far. I was constantly vomiting and experiencing extremely abnormal diarrhoea, which had a watery consistency and was strangely bright green in colour. I was rushing to the toilet every 10-15 minutes, and my condition was so bad that I could not eat anything for five days. My body was shivering and fever-like symptoms, my partner found me collapsed on the hotel room's bathroom floor, trembling uncontrollably yet feeling scorching hot. As the days progressed, my condition only deteriorated further. I made the decision to seek medical attention from the hotel doctor, incurring a cost of 150 euros for a consultation. After assessing my condition, he recommended that I be transferred to a Turkish hospital for further evaluation and treatment. Given that this was a family holiday, my partner and I made the tough choice for me to go to the hospital alone to receive the necessary medical care. In fact, as I walked out of the doctor's room, I was so weak that I fainted on a sofa outside.

 

After I left the doctor's office, I got the taxi alone, staff then escorted me to a private room where I was attached to an IV drip—four in total—The medical staff also requested a stool sample, a task that proved increasingly difficult. I remained in the hospital from 2pm until midnight, and regrettably, the stool sample was never collected or removed from the bathroom during my stay. Upon reviewing the hospital notes, it was determined that my illness was caused by food poisoning and a viral internal infection. This entire ordeal incurred costs approximately 1.3k euro.

Even after returning from my holiday on 03/09/2023, my health did not improve. While I had stopped vomiting, the diarrhoea persisted and drained my energy for an extended period, totalling 10 days of illness. As mentioned I was unable to eat resulting in weight loss that has left me deeply upset. It is important to note that two other members of our party also fell ill during the trip. The eldest child experienced diarrhoea after only two days and remains unwell even after two weeks, now also exhibiting vomiting. Additionally, another child, aged just 10, was ill for four days during the trip, suffering from both diarrhoea and vomiting.

I have contacted our travel insurance company and the company we booked the holiday with. hopefully i will recieve the monies back what i paid in the hospital but would i be entitled for compensation for the distress i endured and the fact i miss half of my holiday ??

    Your travel insurance should cover the medical bills.

    Unless numerous guests were affected and you have evidence that all ate the same contaminated food you'll have difficulty proving liability and gaining any sort of compensation.

    Was this a public hospital or private?

    Did you contact your travel insurer whjile you were in Turkey?

    Agree with the above, you should be able to claim your medical expenses back, but getting compensation will be more challenging. 

    What losses are you claiming for, and if the contaminated food was not tested and there wasn't a mass outbreak, what evidence is there of the cause?

    You may get some form of good will gesture, but I doubt you will get any acceptance of liability and compensation.

    Hope you are now better and the insurance claim at least goes smoothly.

    Did either/both also eat the suspect flatbread with cheese ?
    Were you on a package holiday with a hotel rep ?
    If so, are you aware of him/her having reports from other guests of such symptoms ?
