Hello eveyone, i would be so very grateful for any advice on this matter please.

I have two debts with the  Debt Collection Agencies mentioned above. The Intrum debt is for £3300 for a *credit card with the HFC Bank dating back to 2006. The  PRA group debt is for a *credit card with the Halifax for £7900 dating back to 2001.

Both debts seem to have been bought several times over by different debt collection agencies over the years.

I have been paying both these debts at £20 per month in a payment plan with both debt collection agencies for many years.

On the 7th of September I  requested By recorded delivery, the CCA Requests for both debts.

I have received replies from both in the last couple of days  saying it will take several weeks to locate the CCA Agreements from the original creditor, and that the collections have been suspended on my accounts until they obtain the documents.

Intrum even asked me if i had any documented information from the original creditor. These debts are so old i can't even remember taking them out, or indeed, if they are for *credit cards or unsecured loans.

My question is, What do i do next?

Thank you for any advice you can give me.

  • Don't pay anything until they can produce  CCA's.
    Cancel your payments and wait.
If you go down to the woods today you better not go alone.

I agree with Grumpelstiltskin, if they cant produce them then the debts can't be enforced.

Don't let them have any information you hold, you'd just be giving them information they could use against you.

Thank you both, i  will take your advice.

I don't have any documentation to give them anyway, it's decades old and i've moved house 5 times since the early 2000's thus the paperwork is long lost.
  • definately stop paying them, PRA group are still looking for my cca over 6 years on. its a matter of weeks now until statute barred. Also dont talk to them, do everything in writing

Cheers Django, Good advice. It blows my mind that they are still looking for your CCA after 6 years.

I think they are going to struggle on both of those. I'm not sure what happened to HFC.

I would imagine the reality is that they gave up looking long ago, but are saying they are still looking to try and scare DjangoUnchained into paying by makiing it seem like they might be able to find it. I've had a number of letters from dent collection agencies and they are carefully worded to try and instill fear.

yes, i am quaking in my boots. I believe it is very close to being statute barred but i will carry on ignoring them for a couple of months to make sure. Then i will write to them telling them to f*%?! and stop harassing me and i want it in writing within 14 days or i will lodge a complaint with the FCA

Can anyone let me know how all this affects my credit rating?.

These are my only two debts and i've never defaulted on the monthly payments in all these years to whichever debt collection agency held my account before they sold it on to another firm. I don't have any other credit cards, Loans, store cards or overdraft's... just these two debts which have been enough alone to give me endless sleeples nights.

I don't know why but I've never been threatend with a CCJ from PRA or Intrum ,  maybe as long as i stick to the payment plan, they won't .

I Do have to supply them with a written yearly budget expense/income form for the payment plans.

Anyway,  i woke up this morning feeling positive about all this for the first time in years. Thanks all for your advice, i no longer feel alone in dealing with this issue in total ignorance. I so wish i had asked for advice earlier. Lessons learned.

ps. I'm a natural worrier so I think i will put the £40 per month i pay to them aside until they can produce the CCA's. Just incase.
