The watch was sold and dispatched from Amazon itself.Despite being just out of warranty, and knowing it was sold by Amazon, Withings are still offering a refurbished replacement due to this acknowledged design flaw. So credit to Withings for their response.
From the information given above this appears to be a good offer. I was hoping they’d offer the newer model as they have for others (from reports on other boards). As this would get around another annoying, but liveable with, design flaw. I’ll sleep on it (after a very long day at work) and decide what to do tomorrow.

Thank you for all the advice above.
I accepted the offer of a ‘refurbished replacement’ and completed the order process. The next day an email arrived saying there would be a 3-4 week delay. Now over 6 weeks later nothing has happened. Contact enquiring about order status was slow to be answered and then just got an ‘we’ll escalate it’, then silence again. I’m getting really fed up not having a watch.
Others with the the same issue just a few weeks before me (1 post was even on this site) were provided with a (new) watch after a couple of weeks raising the issue. Seems something has changed within Withings 😢0 -

Do the others that you mention received the newer watch (which may have still been a "refurbished" unit) have detail on how they achieved that outcome?

The other posts sounded like it was a process of attrition, similar to my efforts i.e. not backing down, and it sounded like brand new watches were received. The last post like this was a month before my watch broke. I argued my case too but they wore me done. Then the good legal advice here convinced me to cut my losses and accept the replacement.0

You may find that the "refurbished" unit when it arrives is actually a brand new watch0

That would be great.
However I’d currently be grateful with them simply replying to my messages re where the replacement watch is.
I was so exasperated this morning I took to Twitter (rare for me).0
