  • OP, it would really be appreciated if you could follow the guidance on the Template Defence thread instead of asking for personal advice on things that are fully covered there. To save you looking it up:

    8. Wait for your own Directions Questionnaire from the CCBC, or download one from the internet -
https://www.gov.uk/government/publications/form-n180-directions-questionnaire-small-claims-track and then complete it as described by bargepole in his 'what happens when' post linked from post #2 of the NEWBIES thread - https://forums.moneysavingexpert.com/discussion/comment/64350585#Comment_64350585

    9. The completed DQ should be returned
by email to the [CNBC] to the same address and in the same way as your Defence was filed earlier.

    10. Send a copy of your completed DQ to the Claimant (or their solicitor if they are using one).  Their postal address is on your Claim Form but you can find an email for them by searching this forum, or Google it, because a DQ sent by email is OK and then you know/can prove it's been sent.

My personal view is that when you get to the question about mediation you should reply in the negative as the only thing that will happen in mediation is that the mediator will try to persuade you to pay.
  • Thank you for your replies
Apologies for asking questions that have already been answered on this forum. When I prepared my defence this forum was invaluable and I am thankful for all your help, but I found it difficult to navigate the forum and digest all the information, I've never done this before and spent hours finding the advice required. So I thought a simple question to you knowledgeable and helpful people would be quicker.
I didnt expect to receive this letter, from previous reading on this forum I expected the next correspondence to be a court date several months down the line?
I understand I have to complete and return the form, I just wanted to know if I should choose the Small Claims Track or not, and what it was?
  • It’s the correct track for a small claim

All the questions in the DQ are covered in the NEWBIES thread, under the (red capitals) heading 'IMPORTANT: KNOW WHAT HAPPENS WHEN' which will help you.

UPDATE - Good news!: A couple of weeks ago I received a letter giving me my court date for April. In this letter (I assume the claimant received exactly the same one) it said the claimant had until 28th March to provide further details and pay a £28 fee otherwise it would be thrown out.
Then a couple of days ago, DCB Legal sent me Claimant’s N279 Notice of Discontinuance, so its all over!!! I won!
DCB Legal were still sending me offers of reduced payments to end it without going to court up to a day before they discontinued court proceedings! It's almost like they had no intention of going to court because they knew they couldnt provide the details the court was asking for or they didnt want to pay the fee, but they still tried to get me to settle out of court to get some money from me! They shouldnt be allowed to start court proceedings knowing they have little chance of winning, then discontinue further down the line, theyre trying to scare people into paying up rather than go to court.
I hope it cost them money that theyve lost to start the court proceedings?
I wonder how many people pay up to avoid going to court, I'm guessing alot otherwise they wouldnt do it.
I think its disgraceful, its borderline fraud! And they are causing unnecessary stress and wasting peoples time

Anyway I'm glad it's all over, and I give a massive thanks to everyone on here who has helped, I couldnt have done it without this forum and your replies....thank you
They never did. I'm not sure whether, in your research, you came across the following thread, because their pattern of behaviour is so predictable (provided the motorist complies with the requirements of the court process).  Well, your case is now to be listed there too!  Well done in seeing them off. 👍

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Well done on your win, PARKING EYE with more egg on their face

It's just a try on in a childish attempt to extort money
Parking Eye are well known for farming out debts they know are rubbish.

The perfect partner is DCBL who seem to love wasting their money

As the DCBL claims go totally against the Supreme court ....county courts know this because of their fakery, no wonder DCBL chicken out at the last minute
