Policy Expert ignoring Ombudsman ruling

I have made a complaint about insurance company policy expert and the complaint was upheld by Financial Ombudsman and redress awarded. Policy expert have ignored the ruling and despite the Ombudsman's request they didn't get back to me or paid mke anything.
I have just let Ombudsman know about it as over a month of time has now passed.

Assuming Policy Expert continue their stance and do nothing, where do I stand with the things?  It is written verywhere that Ombudsman's decision is legally binding. Can I send bailiffs on Policy Expert?

What is the job title of the person that made the decision at the Ombudsman? Initial decisions are normally made by investigators/adjudicators and if either party disagree with the decision it is then escalated to an (not "the") ombudsman.

If PE dont follow the initial decision then it would normally be taken as an assumed objection and so escalated to an Ombudsman, unfortunately that means you go back into a long queue for the case to be looked at. Once the Ombudsman makes a decision its at that point it becomes binding.

If they have continued to ignore that then it's time for court... an ombudsman's decision from the Financial Ombudsman is legally binding so you dont use MCOL and the court doesn't consider the underlying dispute. Instead you use N322A form is used to get a court order to enable enforcement against the decision, the £44 cost can be added to your claim along with statutory interest.
  • Hi, I am having a dispute with Policy Expert as they have refused my claim and told me to go to Ombudsman (which is quite shocking customer service).  May I ask Mishomeister whether you managed to get anywhere?  Thanks

When giving their final responses, financial businesses are obliged to advise complainants that they have the right to escalate to FOS.
