No prejudice offer for PCN. Will this stop the CCJ?

Hi all.

Need some help. I parked in a car park for work but my number plate was not put on the parking eye system properly. It has now come to the point where there are letters from the county court. Work has been trying to get this stopped but it has been going in for months and I need this sorted.

My most recent letter from parking eye states this......

"without prejudice to save as to costs"

We write regarding this above referenced Parking Charge were we are seeking to recover the sum of £370.00. We are now in receipt of further information and to reduce costs to both parties, we can confirm we are prepared to accept £70 in settlement of the outstanding claim.

I want to know if we pay this offer does this stop the CCJ proceeding?

What letters? Have you had a claim form (N1)? If so, did you submit AOS followed by a defence? Has there been a small claims court hearing that you lost? Has a judge issued a judgment? What date and how much is it for? Is there still time to pay it and avoid it being placed on your credit file?

What do you mean "...stop the CCJ proceeding"? You don't have a CCJ.  A CCJ doesn't "proceed"! Even if it went to court and you lost, you still wouldn't have a CCJ if you paid it within 30 days of the order.

Stop imagining that you somehow have a CCJ just because some scammer says you are going to get one.

Yes it does. They are indicating they have a weak case and will settle for £70

    Yes it does.

Assuming you don't have a CCJ and just a live claim.

This could have been cancelled at the time of the PCN with one email from your workplace.  Always complain to the landowner early.  You'd have paid nothing.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
