No Win No Fee CFA

Hi all,

I'm currently in the process of making a negligence claim relating to the death of my father. Two solicitors have advised me that we have a good case and are willing to take it on on a no win no fee basis. This arrangement is suitable to us as we certainly couldn't afford to do so otherwise.

One solicitor wants us to sign a CFA immediately, the other wants to obtain medical evidence first and assess it, and then have us sign a CFA.

I'm just wondering if anyone with experience finds either way problematic? As in should it be done one way or not the other? I'm a bit confused on the discrepancy here.

    Ask the 'other' solicitor concerned why they want to do it this way if they have already assessed it (?how?) as a case with a good prospect of success - and in particular ask who pays for the medical evidence. You may get a 'better' agreement the stronger they believe the case to be, so don't jump to the conclusion there is anything dodgy about their approach.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    If neither have seen any medical evidence I can’t see how they would be so sure you have a good case.
