UKPC unpaid PCN from 2021

Hi
UKPC seem to be taking me to court for an unpaid PCN from 2021. I'm feeling confident - I was parked in my housing estate car park, in a designated space outside the house where I lived at the time, and the PCN was issued the day after I paid the estate management company for 2 parking permits and was told over the phone that I had a 1 week dispensation starting immediately; credit card statement is proof pf payment. The estate management company also admitted culpability over email, saying if I pay the fine then they would refund me - which seemed like a terrible suggestion as it was their incompetence that got me the PCN in the first place!
I'm a bit worried that my N180 (dated 5 Aug) had a deadline of 22 Aug and arrived while I was away... on 23 Aug according to the post-mark on the envelope! A day after the deadline! But I saw other people's advice about late N180s and just returned it today 1st class post, fingers crossed. Anything else I should do?
Any other advice about resident parking PCNs? I saw something about the property lease being important, but I was renting the house
Thanks!

The AST/lease is very important and you should make every effort to obtain a copy. You need to read what the AST/lease says about parking, permits, third-party scammers operating the car park as a business, etc. What it doesn't say about parking is also important.
More often than not, the imposition of a permit scheme is something dreamt up by the PPC. For example, if there is no mention of any requirement to display a permit in your car in your own demised parking space, the only reason you could be doing so was as a courtesy, not an obligation. UKPC signs are always inadequate and are a strong defence point.
Have you received a Letter of Claim yet? Are UKPC using DCB Legal to correspond with you? Typically, we almost always see them discontinue before it ever goes to a hearing. They are intellectually malnourished bedfellows and when robustly defended, they are almost guaranteed to capitulate and discontinue as you can read about in this thread:DCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS

Assuming they employed UKPC and they have admitted they are incompetent ..... why should you pay .... all they have to do is tell UKPC to cancel
They are the organ grinder and UKPC are simply the monkey. Just tell them to cancel2 -
The OP has described how they have just returned a Directions Questionnaire.B789 said:Have you received a Letter of Claim yet?
@Von-Chops, being a few days late returning a DQ is nothing to worry about.1 -
But I saw other people's advice about late N180s and just returned it today 1st class post, fingers crossed. Anything else I should do?Yes, and it's essential, - do it again via email to the CNBC (address in the NEWBIES FAQ Announcement, second post), and you must also copy in the solicitors representing UKPC. Sending post to the massive mail centre at the CNBC, where they are a month or more behind in their admin, is an accident just waiting to happen - and you'll be it's victim, especially as you're already a few weeks late. 'Fingers crossed' is not an appropriate 'hope' in a litigation scenario. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks! I'm away from home at the moment, so don't have access to the letters I've received previously, but I have definitely received letters suggesting to settle out of court, and had phone calls - I've ignored all of it. DCB Legal is ringing a very loud bell - I'll check but pretty sure it was them
Getting the lease would be a challenge - the landlord lives overseas and I'm no longer renting the place, so he has no reason to help me
But reading the thread about DCB Legal dropping the case before it gets to court is reassuring! Thanks! I'll update as this one progresses...0 -
Try the agent for a copy of the lease
The email from the agent admitting incompetence is perfect for the judge, if it goes to court
But, DCBL want to settle this out of court, the famous sign they don't to want to go to court
Enjoy the fun1
