    I had a similar thing happen, RM in my case admitted they delivered to the wrong address, tried to recover the item and failed and still denied me compensation!

    I’ve had 3 similar shaped boxes disappear now , all showed as delivered but not received, I have made a formal complaint and have been told that staff member(s) will be re educated about delivery procedures going forward. 

    As you can see from my thread, I had to spend a lot of time and effort on this and 2 retailers sent new items and the eBay one was refunded as a goodwill gesture by eBay as seller knew they would be unable to reclaim their loss on an expensive item.

    When buying similar items we now warn the retailers that they might need to disguise the boxes , or remove their Branding as it seemed that certain items were being targeted.

    If you are a consumer and the seller is a business then they (the seller) are reponsible for the goods until they come into your physical possession - unless you have identified someone else to take delivery for you.  See s29(2) of the Consumer Rights Act 2015 (legislation.gov.uk) here.

    So if RM didn't deliver the parcel into your hands and if you haven't nominated someone to take delivery for you, the seller remains liable for the parcel.  If RM didn't deliver it to you that's the seller's problem with RM, not yours.

    How much is it worth and how did you pay?

    Unfortunately these are Ebay orders and Ebay will side with the seller if they have proof of delivery from the sender. While it doesn't change the law it does mean that you would have to go to court to get the money if the seller doesn't offer it.

    Even in court I'm sure a proof of delivery would go a long way to putting the balance of probabilities in the seller's favour unless you can show, for example, that it's not your doorway.  
  • Out of interest - do you know if the parcel was the consignment or were they shipped on distinct consignment codes - what I mean by that was it the same tracking code for the two items, just with a different suffix (I.e. AX1213213 001 and 002) or was it two distinct codes? If the former (part of the same shipment) then I could see how maybe a parcel would be from a multi parcel consignment. 

    But if not - I can’t imagine that the postie has an option to ‘mark all parcels as delivered’ - they’d likely need to scan the parcels, and thus must be at the point of delivery or the geotag would be wrong. 

    You can certainly ask for the photo. But again, afraid it’s not your claim to pursue and you’ll have to convince the eBay seller you haven’t received it. 
  • The item was worth £55 and the parcels were on different consignment numbers. But Ebay have already closed the claim unless RM admit they did not deliver the parcel
