Management pack paid but still waiting

Hi,
I am trying to sell my leasehold flat, my solicitor requested the management pack to the freeholder's solicitors and they have requested a payment of £400. I did pay straight away, this was at the end of July. Now we are still waiting for the management pack. I know that there is no legal obligation for the freeholder to provide it, however I have paid for it. What can I do now? My solicitor only suggested to chase both freeholder and their solicitor, but now I am getting anxiety, because I am selling to buy another proper and the seller is becoming a big impatience as it's taking so long.

  • Double check that they don't have any specific conditions like requiring you to email them to confirm that the payment has been made, as in some cases freeholders will do nothing until all i's are dotted and t's crossed - even if they are fully aware that the payment has been made!  Did the freeholder indicate what they expected lead-time for delivery of the sales pack was when your solicitor first enquired?

    What your solicitor says is correct. You need to chase the freeholder.

    Technically, it's the freeholder who provider's the management pack - but if there's a management company, the freeholder might ask the management company to do it for them.


    So maybe phone the management company (or freeholder) and ask who is responsible for producing management packs - and ask if you can speak to them. If they won't let you speak to the right person, ask to leave a message and/or ask for an email address.


    And ask things like:
    • Have you received the management pack request that was sent to the freeholder's solicitor on xth July?
    • Have you received the payment of £400?
    • When do you expect the management pack to be ready?  

    Depending on the replies, you can ask what is holding the process up, what further info they need, if there's anything you can do to speed up the process etc.


    (If you want, you can also explain the problems that the delay is causing - that might influence some types of people, but other types of people might just think you're giving them a "sob-story".)
