Parking Charge Notice LBA whilst out of the country

This is my first post, so here goes...
I recently left my vehicle at Leeds Bradford Airport Meet and Greet cark park for 7 days. After returning from holiday approx. 10 days later a charge notice landed through the post for "STOPPING IN A ZONE WHERE STOPPING IS PROHIBITED". Following reading the detail in the charge notice the event happened at 05:42 on the 15th August 2023 and we weren't due to collect the car until 15:00 on the 16th August 2023. Not only did we not commit the alleged infringement but it seems odd that our vehicle was where it was at that date and time, my first thought its been used for an airport run around. for the car park staff. Has anybody else encountered some thing like this and how did or would you suggest I deal with this. It sticks in my throat the double standards that operate in these places.

    Wow.

    Did you use an official Meet & Greet firm?

    Just appeal with your evidence of which firm you booked in and left the car with and tell VCS to pursue that firm instead.

    ALSO make a formal complaint to LBA and ask them to look at VCS' footage to try to see who at the Airport has done this while you were on holiday!  Those responsible need sacking.

    Read the Newbies/FAQ thread. You need to query with the parking operator you booked with. However, do not just try and appeal as you will lose and probably throw away the best chance to get this thrown out. 

    Whilst you do not know the name of the driver and you can probably prove you were not in the country anyway, you can only appeal as the Registered Keeper (RK). No liability can be transferred to you as the RK because they cannot rely on PoFA 2012 as the land is covered by byelaws, and can only pursue the driver.

    You just appeal with the following:
    I am appealing as the Registered Keeper. I was not the driver and can prove I was out of the country at the time. As you cannot rely on PoFA 2012 to transfer liability, I suggest you ask [Meet & Greet Company] who the person was driving my car at the time.

    If you do not cancel this PCN, you can waste your money by rejecting it. However, I will not be bothering with a second appeal through the IAS as that kangaroo court is known to operate as a cartel which only looks out for the interests of its members.

    Yes - good point - but this OP must surely add more, due to the use of the car without consent, by an Airport worker!

    Also complaint to LBA immediately and maybe get it in the local paper.

    It's possible the car was being moved from medium term storage to short term storage in anticipation of the arrival back of the OP the following day.  You don't know it was "without consent". How are they meant to meet and greet him if they can't drive his car and store it in a relevant place? Suspect the terms he agreed to will have allowed the firm to move the car for this purpose.  Doesn't mean he is liable for this invoice though, I agree there. 

    Which firm was it? Is this the official airport one? What have they said about it? That needs to be your first port of call before an "appeal".
    Just ask them why your car has been photographed in a restricted area, resulting in you getting an invoice, over 24 hours before you even arrived back in the country, and let them answer that first. 
    If you don't get a satisfactory answer (in this case an explanation, an apology, and the cancellation of the charge) tell them you will have a chat with the Yorkshire Post and Leeds Live.

    If the firm isn't the official airport firm and is in fact a third party cowboy firm, you may find it a bit more difficult.

    Two separate issues. The one concerning the PCN needs to be dealt with. I seriously doubt the PPC will give a toss about whether the car was being driven by an employee of the Meet & Greet service. They want their money and would probably tell the M&G company to sod off as they are not the landowner and not the RK.

    Just get the appeal done. They will probably reject it anyway. If it's VCS, there is no point in appealing to the IAS.

    Separately, the OP should contact the M&G company for an explanation as to how they managed to get them a PCN.

    As for contacting the airport, they could probably get the PCN cancelled as the landowner and is the Plan A attack. Getting the media interested is more likely to get the M&G company to apologise but I doubt little else.
