    @ATownson1 thanks for the update. I’ve not heard anything further which makes me think they have finally for the message that they can’t be chasing these so called old debts. Let’s hope FOS do the right thing

    @Staceylou85 FOS have responded to say they've received the file from Lowell who have increased their compensation offer to £150 and they deem it fair, together with their apology that there was never a CCJ taken out against me and Hoist had not contacted me. I've refused their offer based on Lowell's response that they will not pursue me for the debt (legally it is statute barred) and will not file anything on my credit reference (there is nothing to file). Veiled threats once again. The FCA have referred it to the team who deal with Lowell to ensure they follow their standards and treat consumers accordingly, which they don't. I've asked the FOS to explain why they consider it fair when no one has answered my questions.

    Lowell have a few addresses as they have different arms under different names, such as Lowell portfolio one ltd, and Lowell Financial ltd.
    @sourcrates can I ask. If this debt is a joint account, but the CCJ is in my ex-partners name only. Could the CCJ relate to a different debt and Lowell are manipulating info for their own needs. No one seems to have any info on the CCJ. What info would a CCJ show? FOS are saying debt is not statute barred cos a CCJ has been served on it. Hence they think that Lowells are being fair in their outcome. My ex is liable to have a few CCJs, thankfully this was the only joint account we had!

    The issuing court can tell you the creditor the judgement was granted in favour of.

    Expect companies such as Lowell to be deliberately mis-leading.

  • If no action has been Taken at the court for a few years, they won’t have any details of the CCJ or the claim. They’d they the claim from the claimant. Which Lowell nor hoist have so but the sound of things they can only give basic info.

    Lowell have confirmed that the CCJ is in my ex name only. I've refused Lowell offer and disputed that this was an admin error on their part with the FOS. FOS now doing a full enquiry. Whatever the outcome, it's finished thankfully.
  • So, i need a little help more on this.  So lowell have continued to write so i sent them a formal complaint advising that they havent responded to my points raised nor provided proof and to also treat this letter as a letter of claim.  Lowell have responded and said that they have closed the complaint and now referred this to overdales (i think due to the letter of Claim). I mean what can overdales really do? what shouold i do next?
  • What can Overdaels do? Shuffle a few papers around, perhaps write and say they may do this and that, but basically don't contact them it will only encourage them just wait and see.

    Well I know they have one person who is like a bull with a red rag. But like I said, this judgment was way back in 2000 and issued to the PG’s address, last payment 2009. Wasn’t till Lowell took over that this has now come up. As hoist didn’t contact for years, is t there something in GDPR about keeping details? I just want them to stop and ignoring them doesn’t work. Also, in relation to my complaint they’ve discontinued could I raise this with FOS as they haven’t address my complaint, just passed it to Overdale
