Sadly, trying POPLA first was a mistake because PE are now unlikely to cancel because of that.

The Royal Free are also historically terrible at supporting patients over their beloved ParkingEye.  'Deluded' describes the responses I've seen in previous years from one particular awful woman who made it clear she didn't give a damn.  I hope she has left and they prove me wrong.
I shall surely report. but not sure why Popla report was wrong? this is a course of action prescribed by the operator himself.
It was a mistake for you to try POPLA.

It's not independent and you were unlikely to win, AND that kangaroo court has cost ParkingEye £27 which means they'll dig their heels in unless you have a robust MP who will push hard.

In the NEWBIES thread, PLAN A is 'complain to the landowner' and appealing is waaaay down the advice steps. You could quite possibly have seen this cancelled had you cone here first and tried PLAN A before any appeal.

Sadly you did it the wrong way round, having believed what the 'outrageous scam' letter said and therefore being corralled to POPLA, which is funded by the private parking old boys' club, for them and essentially it runs in their interests.

This is why the Government is replacing POPLA and its rival, and is robustly regulating this rogue industry.
I note your comments, but what's done - done. I now will be hoping for the MPs to intervene. I have emailed both my local MP and the MP of the area where the hopistal is located. Such a shame these crooks are still allowed to operate. I will update once I hear anything from the landowner (the hospital).

You should complain to the Trusts CEO directly, about both the failing of PALS and about your PCN.
I have emailed him at the very first instance - once I had the PCN and I received no reply whatsoever. I can write to others, perhaps, if I know the names.

I dont think they are interested at all tbh.

UPD: Rachel Anticoni Director of Operations has responded to me within 10mins of contacting her PA. She has promised to look into this for me. At the same time my MP has responded that he will contact ParkingEye and has asked for the reference in order to talk to them. So... we will see.

UPD2: Thanks for coming back to me so quickly.  I am sure if your appeal has been rejected by POPLA then there should be no problem.

I will chase and get back to you probably after the weekend.  I am hopeful this will be resolved.

UPD3 the parkingeye crooks have sent me a goodwill gesture invitation to pay just half of the penalty due following the pressure from the MP and the land owner. the landowner is unsure how else they can help. I think it now confirms the fact that POPLA is paid by the parking company to review the appeals (£27 or so). and hence parkingeye are unwilling to be out of pocket. I'm still trying. might send them a letter from an attorney. but I guess the crew here would suggest i have now exhausted all the options?

Refuse to pay it.  That's what I'd do.

We don't have attorneys in the UK. Don't send them a solicitor's letter.  Costs you money and looks weak.

    Email:

Obviously, the PCN number in the subject line...

Just say no, you are just trying to make me pay for POPLA which is not allowed to be passed on to the consumer.  Take me to court if you think you have a case.

Copy in the Director of Operations and your MP and tell them that forcing victim consumers to effectively pay ParkingEye's POPLA fee is not allowed.  The service is meant to be fully industry funded and must never affect a parking operator's cancellation.

Great result, that's the end of it. Well done on your resilience. 👏
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
