TERMS AND CONDITIONS for “KISS FM x Magnum – Breakfast Promotion – 6th September – 14th September” (the “Competition”).

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

1.ENTRY ROUTES AND COSTS	Entries are restricted to one entry per person.   Entry to the Competition is available via the following routes:   Online at https://planetradio.co.uk/kiss/   Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	Pre-registration for this competition is open from Wednesday 6th September 2023 00:01 and closes Thursday 14th September 2023 at 17.00.   The on-air element of this competition is in play Monday 11th September – Friday 15th September 2023 during the KISS FM breakfast show.    2.1 Pre-registration   Entrants must enter their details via the competition form to pre-register their interest to play.   Registering to take part in this competition does not provide any guarantee that you will come on-air or win a prize.   2.2 Shortlisting and being invited to play the on-air game   There will be 5 chances to win which will be executed in daily competition rounds during the KISS FM Breakfast Show from Monday 11thSeptember – Friday 15th September 2023 (see 2.4 How to Win).     Being short-listed does not deem you a winner. You are not a winner until told by the production team after the competition rounds on-air.    For each of the competition rounds, there will one entrant chosen by random electronic draw from all valid entries up to that point.  These contestant draws will take place at the below dates/times:   For the competition on Monday 11thSeptember 2023, the draw will take place at 9am on Friday 7th September 2023.   For the competition on Tuesday 12thSeptember 2023, the draw will take place at 9am on Monday 11th September 2023.   For the competition on Wednesday 13thSeptember 2023, the draw will take place at 9am on Tuesday 12th September 2023.   For the competition on Thursday 14thSeptember 2023, the draw will take place at 9am on Wednesday 13th September 2023.   For the competition on Friday 15thSeptember 2023, the draw will take place at 5pm on Thursday 14th September 2023.   There is one daily prize to be won each day Monday-Friday for the successful entrants that make it to the on-air competition. On Friday, there will be two prizes to be won (see 5: The Prize)   If any shortlisted entrant cannot make the agreed date and time, they will forfeit their chance to enter the next round and the production team will move on to another randomly selected entrant from the short list and repeat the process until they have found someone that can play in the on-air game.    Speaking to a member of the production team does not guarantee you will be invited to play the game or win the prize; only when told you are a finalist by the team will you progress to the next stage of the competition.    2.3 The Competition   The Competition will air during the KISS FM Breakfast show between 07:00am and 11:00am Monday to Friday during the on-air competition period (see section 3. DATES). Exact timings of the competition within this broader timeframe will be announced on the day by the presenters. There is the chance that some of these competition rounds will be pre-recorded prior to the show times but after the finalists have been selected.   2.4 How to win   “The Quiz that gets Quicker” is a daily feature on the KISS FM breakfast show and is a quiz-based game with time limits against each question. Jordan and Perri will ask the entrant 5 questions and the entrant will have to answer each question in a set amount of time. The entrant must answer as many questions as they can within the time limit to win a prize. (The question being read counts within the time limit).   From Monday 11th September – Friday 15thSeptember, the entrant will successfully win the prize (mentioned in 5.0) regardless of how many questions they answer correctly. On Friday 15th September, the entrant from each Quiz that Gets Quicker competition round from the week who has the most correct answers and is top of the leaderboard will be announced and awarded an additional prize.  If there are two or more entrants on the leaderboard with the same number of questions guessed correctly, it will go to a tie break. Off-air before each Quiz that Gets Quicker competition round from Monday 10th July – Friday 14th July a tie-break question (closest to the pin style) will have been asked. If a tie-break occurs to announce the top of the leaderboard win on Friday 14th the tie-break answers will be used to determine the winner.  There will be up to 1 winner per day, 5 winners in total across the competition period (5 days).   The production team’s decision is final.  The KISS FM’s production Team reserve the right to pre-record any part of this competition with contestants before the 'as-live' broadcast.  All final decisions rest with the KISS FM’s production team.
3. ENTRY PERIOD	Pre-registration will be open from 00:01 on Wednesday 6thSeptember (pre-registration start date) until 5pm on Thursday 14th September 2023 (pre-registration end date)   Entries received before the pre-registration start date or after the pre-registration end date will be invalid.   There will be 1 x ‘Quiz that gets quicker’ competition round broadcasted every day from Monday 11th September (on-air start date) to Friday 15th September 2023 (on-air end date) during KISS FM’s Breakfast Show between 06:00am – 11:00am Monday to Friday.   There will be an additional winner announcement Friday 15th September 2023 during KISS FM’s Breakfast Show between 06:00am – 11:00am Monday to Friday where the entrant who is top of the week's ‘Quiz that gets quicker’ leaderboard will be announced.    Please note KISS FM reserves the right to remove the competition for any event such as a public holiday.
4. ENTRY RESTRICTIONS	Open to UK residents aged 18 years or over on date of entry.  Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. Anyone who has won a Bauer competition to the value of £500 or more within the past 6 months on any Bauer Radio Brand, will not be eligible to take part in this competition nor will anyone else at their address. 5. THE PRIZE

1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

1. MISCELLANEOUS. 

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into. 
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call. 
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route. 
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition. 
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

 

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
