ECP - No valid pay and display/permit was purchased

Never had a PCN before in my life and now two within a month of each other, both in the south west. In this instance a completely different scenario in the neighbouring county.

This time in a ECP car park on Wetherspoons land. The driver paid and displayed for an hour. The ANPR cameras clocked 1 hour 6 minutes. The PCN shows "No valid pay and display/permit was purchased".

I phoned and spoke to Wetherspoons but all I got was a well rehearsed short speech that I would have to contact ECP as they can do nothing about it. Clearly this is a common occurrence.

I've seen other similar threads where people have elaborated on the plan b template in the newbies thread, but as this ticket was paid by cash and I no longer have it, would I be best to just stick with the basic template as written, or can anything else be added?

    You would really think that photo of the car not paying and displaying would the clear-cut way to accuse someone of not paying and displaying. Although that wouldn't be very beneficial to them when trying to scam innocent people that have paid and displayed...

    Presumably there's a VRM typo on your receipt.  It was a keying error - one digit?

  • No receipt. The driver bought a pay and display ticket with cash, after entering the VRM on the machine, and no longer has it. The PCN just shows ANPR images of the car arriving and leaving, claiming no ticket was paid and displayed at all

    Appeal saying how much was paid and when, and ask them to check their records for a likely system or 'keying error'. They must supply evidence of their findings (the machine logs) with the rejection letter/email, in the event that they can't be arsed to comply with the DLUHC CoP and refuse to cancel.

  • I've received a response to my appeal and as appears to be standard practice, they now want just a £20 admin fee (how about, no...). The reply shows the logs that consist of just one entry that shows only the last 3 letters of my reg, "which suggests there has been a major keying error". Surprise surprise!

    Or a major recording error by the PPC.

    If not paying the £20 (some do, some don't) I would just ignore it now because the new Code of Practice covers this and says ALL keying errors should see PCNs cancelled.

    That will fly in court in 2024 if they try.

    It will not win at POPLA. Because they offered you a £20 settlement, POPLA will think all is OK.  Up to you if you bother!

    How does that (the last three digits recorded by the PDT) prove it was any sort of keying error or machine malfunction unless they show the complete VRM recorded?
  • I am in exactly the same position with ECP. The transaction payment shows on my bank statement but they are saying that a "major keying error" was made and shows only the last 4  numbers of my car registration number so the contravention is 'that no valid pay and display was purchased.' I can now pay the £20 admin fee and the PCN will be closed. Do I appeal to POPLA as I have no way of finding out now about the registration error but why  drop from £100 to £20 and also the charge notice will be closed. Do I appeal to POPLA please?
