Section 75 In my favour then sent an invoice

I hired a car from Hertz earlier in the year, when I picked it up they said it had some damage on the rear bumper, a light scratch. When we went to look at the car before I drove off I pointed out that there was NO damage, the agent seemed a bit taken back and didn't know what to say. It was obvious that this location was just out to scam customers.

SO when I dropped the vehicle off at the airport (they were closed so told me to leave it in a certain car park) I took 4k video and photos of every panel. They didn't collect the vehicle until the next day.

Sure enough, a few days later I got a bill for damage! Again, light scratches. Pencil marks in other words (it' an old trick)

I sent them the 4k video and photos of the areas they said were damage proving that there was none. I got an email back which didn't even mention the evidence I provided.

I disputed the transaction with American Express.

After a month the dispute was found in my favour.

Today in the post I receive an invoice for the full amount from Hertz again.

Can hertz even do this once a dispute has been found against them?

    It will have been a chargeback, rather than s75.

    And yes, the retailer can still pursue payment. Amex aren't a court of law.
  • I don’t think you have got the hang of why they point out any existing damage when you pick up a car. Any damage pointed out on pick up will be documented so you don’t get charged for it on the return. If the damage was there but you could not see it and were insistent that there was none, then your insistence is likely the reason you got charged after dropping off the car.

    That was a very silly thing to do... when you pick up the car you want absolutely as much damage as is humanly possible to be noted on the sheet, that way when you return it they cannot pin it on you. I fear in this case you are the author of your own misfortune and shouldn't have argued that they remove the pre-existing damage. 

    As has been said, based on what has been said this was processed as a chargeback not a S75 and as such the money has been taken back from Hertz. Banks and card networks however are not a court of law and the chargeback process is fairly crude in nature. 

    Just as if the bank had ruled against you you would still have been free to sue Hertz so Hertz is free to pursue what they believe is your legitimate debt to them. 

    Have hired from Hertz Inverness a few times and never had any issues with vehicle returns, but then I never told them to remove pre-existing damage from the sheet either!

    Just how would that scam work then? Do you get charged if you take the car back in better condition than it said on the sheet when you took it out?
