Shell over the price cap?

Ive not had the time to go into my utlity charges since my original provider went under and I got moved to Shell by default on what I presume is a bog standard tariff .(Flexible 11 DD ebill) Is the price cap an actual law, or an advisory, because having the time to look now , Im seeing that Shell is charging me E31.09p pkwh and 61.81p standing charge, whilst the cap currently is according to MSE 30p and 53p Standing CH ?

Edit: the 30p/53p are an average of all regions, but I don't think any region actually has the exact average. South Wales looks to be the closest.1
