Ive not had the time to go into my utlity charges since my original provider went under and I got moved to Shell by default on what I presume is a bog standard tariff .(Flexible 11 DD ebill) Is the price cap an actual law, or an advisory, because having the time to look now , Im seeing that Shell is charging me E31.09p pkwh and 61.81p standing charge, whilst the cap currently is according to MSE 30p and 53p Standing CH ?

There is no one price cap, or the rates for it, the vary regionally.

Prices vary by region, with the standing charges having most variation.
Looks like you're in the North Wales & Mersey region https://www.moneysavingexpert.com/utilities/what-are-the-price-cap-unit-rates-/#unitrates
Edit: the 30p/53p are an average of all regions, but I don't think any region actually has the exact average. South Wales looks to be the closest.1
