Completely irrelevant to the point in hand as its a PCH / lease deal, therefore the hirer doesnt own the car, cant sell it at the end of term and MUST pay any excess miles charges and any damage about fair wear and tear.
Noted. It's just that the OP then goes on about PCP advice on mileage charges being unenforceable with a view to using it.

And the sound you are hearing is the crinkle-crunch of a large pile of straws being clutched...

    That's the one.
  • I wouldn't think for second there's a water tight way of getting around these fees.  It's in the contract signed on delivery, break the contract and look forward to the consequences.

Regardless of whether the finance method is PCP or Contract Hire the excess mileage charge is part of the signed leasing agreement and is 100% enforceable.
The PCP one is avoidable by availing of one of the other options at the end of term rather than hand the car back.

Also with PCP you could return the car once 50% of the total agreement cost has been paid (including any deposit, finance contributions and monthly payments) with nothing further to pay.  That is a legal right, however the finance company could still pursue you for the mileage charges.  Whether or not they would be successful if it went to court would be another thing.

That 50% marker is usually reached close to the end of the PCP term anyway.

BUT - i'd be looking at finding ways to avoid handing the car back if i'd a PCP deal coming to an end, which i'd only do as a last resort.
