Bank asked me to decide the reason for Section 75 claim?

I have had nothing but problems with a new Nokia phone and out of chargeback period.Bank states for Section 75 I need to prove that I have been misled or misinformed when sold the goods and I need to decide what this is ? .The tale is twofold.Phone started having problems 2 months after purchase.Tried to resolve things over the next month.
Sent back for repair although at just over 4 months.
1. The phone sent back to me was a replacement showing more wear than my original.Still awaiting reply on disputing this.
2.I still have one of the problems.My phone will switch back on from off when I try to charge it.
Maybe Section is not the way to go ?any other suggestions? Brought from new on Nokia's website and shipped from Hungary.
