NCP Charge / BW Legal letter / Claim Form

  • Thanks, I've read the guidance on how to file an Acknowledgement of Service.

Noted on not admitting to any of the claim. I have read through the defence template.

However, I did just forget to pay for parking on those two days. I have paid on all the other days I've parked. Therefore I'm not sure what defence I really have - my main issue is that the charges seem totally unreasonable and inflated given that their loss for those two days was £16 total (£8 per day).

Is it still genuinely worth defending when I forgot to buy tickets?

What do you mean "you forgot/didn't pay"?  It is not for you to do the PPC's job for them, it is for them to prove their claim!

The POC doesn't plead 'non-payment' does it?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No. It says there was a 'contractual breach' and that the driver failed to comply with the terms and conditions as displayed.

Exactly, which is why you just look at a few other defences for inspiration for your para 3 and don't answer allegations not pleaded.

I've already written 95% of the defence for you.  Simply add something about the site and put them to proof of breach.

  • I’ve nervously submitted my AOS!

im now preparing a defence - I’m looking through other threads, including the NCP Railway one you mentioned @Coupon-mad

Please do let me know if you have any further advice on how to defend in this scenario.

Finally, in your experience, if this goes to court, is it definitely something I would need to attend in person? Secondly, if I did lose are the costs likely to exceed those listed on the claim form?

    Thanks

In your first post  you said it was "likely" you forgot to pay. Now you have talked yourself into being certain and "guilty".

As others have said, do not do their dirty work for them. Respond to what is in the POC !

The NEWBIES thread already tells you it's less.
