Another McDonalds Southgate Park Claim

Hi all,

I’ve been following the other Southgate Park threads with interest as I too have recently received a claim letter.

I’ve followed the advice and requested a SAR from MET (although subsequently seen advice to the contrary)and have received a response.  However, the content of the response consists of just the original claim letter they sent.

I asked for;

“     - All photos taken of myself or my vechicle.

    - All letters/emails sent and received, including any appeal correspondence.

    - All data held, including all evidence that maybe used in a future court hearing.”

Is this significant?  There is nothing on the provided letter that even shows me parked just what looks like a picture of my car leaving the premises.

I allegedly parked in the coffee shop part of the car park and went to McDonalds.

NB The car at the time was a lease car that I subsequently bought and still have.  I’m wondering whether that has affected the supplied details as not linked directly to me, but that being the case I shouldn’t get anything.

    What do you mean by 'a claim letter'?

    If you have a court claim you don't do a SAR.

    Hi all,

    Rewording my initial post;

    I’ve received a “Letter of Claim” from DCBLegal for a MET unpaid MET parking charge back in 2018.  I submitted a SAR, to MET, and received back a copy of the original request for payment they sent.  That’s all.  No further info.

    Does this have a bearing on any future court hearing?  If they don’t share the data can it be used?  If it is surely they are in breach of some other SAR legislation?  Perhaps the solicitor now has the info and they don’t?

    I’ve not used their reply form.  Just awaiting further correspondence.

    So they just supplied the PCN?  What else do you want to see, maybe ask for all ANPR data captures of the numberplate traversing the site that day?

    Well I’d like to see everything they have on me/my car.

    I asked for:

    If what they have sent is all they have there is zero evidence that I left the site which is central to their claim.

    Just defend as per the template defence thread and you will see this eventually discontinued by DCB Legal as they cannot hope to win one of these in court. They are just relying on low-hanging fruit from the gullible tree capitulating out of fear. With the robust defence, you will have nothing to fear.
