In the event of my death can I leave my share of my mother's will to someone else?

    In your example, if any of the beneficiaries died before your mother and the beneficiary is a child or remoter issue of the deceased, their inheritance would only be split amongst the remaining beneficiaries if they had no children of their own. The default situation is that children of pre-deceased beneficiaries that are children or remoter issue of the deceased inherit unless the Will specifies otherwise.

    You’re correct! I’ve just double checked her will as it was the solicitor who explained it to me. It does say the following:
     ‘such of my children as are alive at my death’. she had 5 children but my sister died some time ago. So her estate will be split between the remaining children.

    In the sad event that a child predeceases a parent, that order of events can make a big difference. Parent goes first, the offspring's inheritance is distributed according to the wishes of the offspring, as specified in their own will. Offspring goes first and what may have been their inheritance is distributed to their immediate offspring.

    We got asked this scenario when we recently made a will. If our adult children die before us, any money they would have inherited goes to any children they may have and if they don't have any to each other. If both our children were to die before us and not having any children of their own, the estate is split unequally to 5 different friends/relatives and should one or more fail then their share divided equally amongst the others.

    Your Mum's will should explain what happens and if it doesn't then the law will say who inherits next.
