OK so sit tight.  Tell the court and Claimant's solicitors if you move house.  Wait to see if a DQ gets sent to you at some point. There is no deadline for this; the CNBC is under a lot of pressure so some cases are dormant for a while...months.  As long as you don't change your address, you will hear if it starts again.  It isn't over.

  • Thanks for the advice, I didn’t think it would be over yet but I don’t like being left in limbo so just wondered if there was anyway to see what was happening. I was also concerned in case I had missed a letter or something knowing the post service.
So in theory now this process has started could I be waiting years for it to proceed to court?

    Yes. Awful, isn't it.

You could email the CNBC and say if the case is now stayed, you require them to tell you by email you if it starts up again, because Defendants can't be held in limbo for ever.

The current postal address cannot be presumed as a good address for service of this Defendant indefinitely.  if the CNBC ignore this email, you will hold them responsible and liable for any CCJ and/or loss caused by them indulging Claimants over Defendants' consumer rights.

And you require this email to be placed with the file as a formal note not to use this address beyond 2024, and you require that any application to lift the stay later than next month (February 2024), be referred to a Judge and refused and the claim struck out.

  • So I’ve now had the DQ and returned it by the date given so it looks like court is coming up at some point. I was supposed to have mediation today and received no call from the court mediator. Why would this be and what happens now?

Email the Mediation team and ask why the call didn't happen. Did the C not make a rep available, or have they asked to rearrange it?
