Court claim form - Met parking Services - DCB Legal

Hi all

I'm trying to help my friend as he ignored one of those PCNs ages ago.
It already got to the point of the County Cort claim form issued on the 9th of August so I have submitted the AOS for my friend.
PCN number stated on the claim form is not active on their website so just in case I have sent SAR to request for any data they held in his name to see what we are dealing with.
As for writing a defence I just want to double check,

https://forums.moneysavingexpert.com/discussion/comment/76880595/#Comment_76880595

is this the latest template I can copy/paste and just edit 2nd paragraph with The facts known to the Defendant?

Is there anything I'm missing right now or am I on the right track?
Any advice will be highly appreciated

    Make sense now ;)
    Thank you
I will wait to see if they will respond with SAR before the deadline for submitting the defence.

Hopefully the Acknowledgment of Service was filed some time after 11th August. Please confirm.

With a Claim Issue Date of 9th August, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 11th September 2023 to file your Defence.

That's nearly three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

Please keep in mind that everything must be done in the name of the named Defendant.

Your friend's data, which is what the SAR should elicit, will be more useful to him/her at witness statement stage.

So I have filed the defence and received a letter from the court dated 13th of September acknowledging receipt of the defence and that copy has been served on the claimant.
The claimant had 28 days to contact the court with further steps otherwise, the case would be stayed.

On the 18th of October, we received 2 letters dated the 11th of October ( so if I understand correctly that's the last day for the claimant to respond to the court). One letter saying that they want to settle and the other one with a direct questionnaire.
And that was the last communication we had from them.
It's been nearly a month and we haven't received a direction questionnaire from the court so should we assume that the case has been stayed?
What we can do to get an official decision that the case has been discounted or something like that?
We are looking for a closure and some kind of official confirmation this is the end of it.
    What we can do now?

The CCBC sent you a letter saying the Claimant has twenty eight days to consider your Defence.

What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.

Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.

And as that checklist you were following says " YOU MAY HAVE TO WAIT TWO MONTHS OR SO FOR THE NEXT STEP TO HAPPEN".

Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CCBC, remembering to send a copy to the Claimant of course?
