You are rejecting the sale so as far as possible Arnold Clark must put you back in the position you were in before the purchase.wellababe245 said:I have part ex a car got a good deal in fairness had the car 3 days major issue they are happy to refund but are saying I have to take my part ex back is this correct or can I demand full invoice refund
A full refund of what you have paid and the return of your part-ex restores you to where you were so that is correct.
If they had already disposed of your vehicle so could not return it that would be different.0 -
I think that would be viewed as reasonable - you paid in cash and by part-ex, so it would be fair that any refund would be also be in cash and part-ex (so long as they still had your car to give you back).I don’t think you can demand a full cash refund but of course you could then try selling the part-ex to them as a separate transaction. They would of course be under no obligation to give you the same value for the part-ex though.Northern Ireland club member No 382 :j0

I would have thought that reasonable as they are to put you back in the position you were in before the transaction took place.
It would be a great way to get rid of a car with an underlying issue otherwise. Trade in something with an expensive problem, then reject the new car to get all cash back and be rid of the troublesome vehicle.1
