    Sky VIP Wembley Lounge on Capital, August 2023 – Specific Rules

    1.     The Sky VIP Wembley Lounge promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Friday 18th August 2023 to Sunday 27th August 2023 on Capital Network. Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is Sky VIP. The ‘Prize Providers’ are NDL Group and Sky.

    2.     IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.

    Details of the Promotion:

    3.     To enter the Promotion, you must go online to the Promotion entry page at capital.com/win, register your details and submit an answer to the multiple-choice question provided.

    4.     Online entry will open at 17:00 on Friday 18th August 2023 and close at 23:59 on Sunday 27th August 2023. Entries received before or after this time will not be included in the Promotion.

    5.     Within 7 days of the closing time of the Promotion, all eligible entries will be entered into a draw. One correct entry will be selected at random and the winning entrant will be contacted by one of our representatives via email OR telephone on the telephone number on which you entered. If such winner does not respond within 7 days from being contacted, they will forfeit their right to the prize and we shall be entitled to select another winner by another random draw. That subsequent winner must respond to the notification email within 2 days of the date on which they are notified, or they will also forfeit the prize.

    6.     We and the prize provider and the Promotion Partner may publish and publicise your name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to yours and any applicable third party’s (for example a guest/travel companion) association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion.

    7.     In relation to winners (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture.

    Eligibility:

    8.     The Promotion is only open to residents of the UK aged 18 years old and over, and who are based in the UK at the time of entry.

    9.     Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion.

    Prize:

    10.  One winning entrant will receive:

    a.    Return train travel to London on Thursday 14th September returning Friday 15th September 2023 for 2 people

    b.    Overnight accommodation on Thursday 14th September 2023 at the 4-star Hilton London Metropole

    Prize Terms and Conditions A-E:

    11.  Stay must be taken on Thursday 14th September 2023. Winner and guest must be available to travel on these dates.

    12.  Your prize includes off peak train travel. Off peak refers to travel booked outside of morning and evening commuter periods, this varies depending on the train operator but generally excludes departures between 0600-1000 and 1600-1900.

    13.  You will be staying in a 4* hotel, sharing a double room with en-suite bathroom on a bed and breakfast basis with welcome bottle of prosecco and 2 Portion piece of chocolate ganache cake in room upon arrival.

    14.  Your 2-day London Zones 1-4 daily travel cards will be provided in the form of £44.00 spending money. Spending money will be transferred directly to the winner upon confirmation of full and correct bank details. Transfers can take up to 5 working days.

    Prize Terms and Conditions F:

    15.  All services on Sky Glass are streamed via broadband, a minimum speed of 35Mbps is required to use the Prize in full.

    16.  Only one Sky TV subscription can be provided at an address.  If the winner is an existing Sky TV customer and has Sky Q or Sky+, they will need to take a TV subscription for Sky Glass.  We will bill the winner for their existing Sky TV subscription until the Sky Glass TV subscription is activation.  Sky Q cstuoemsr will need to send back their Sky Q boxes within 60 days of receiving Sky Glass otherwise they may be charged a non returns charge.  Third party subscriptions not paid for via Sky but viewed on Sky Q or Sky + will not be viewable on Sky Glass.   Recordings on Sky Q or Sky+ will not automatically transfer. If winners have Disney+ or Spotify via Sky, these will not automatically transfer to Sky Glass and winners will need to sign up directly to each via Apps Marketplace on Sky Glass.

    17.  For 12 months, the winner will get their Sky TV subscriptions via their Sky Glass TV for no charge.  Sky Ultimate TV via Sky Glass is provided on a monthly rolling contract and can be cancelled at anytime on 31 days notice.  Ending your Sky Ultimate TV subscription will end your offer period.  After your 12 month offer period, all Sky TV subscriptions will become chargeable at their then standard price, unless you change or cancel your package, giving Sky at least 31 days’ notice. Standard subscription prices may change. Please refer to www.sky.com for current pricing.

    18.  You must be over 18 and resident in the United Kingdom, Channel Islands or Isle of Mann to win this Prize.

    19.  The Prize does not include:

                                                   i.     A broadband subscription.  All content via Sky Glass is streamed so you must have broadband of at least 35Mpbs to use all the elements of this Prize; 

                                                  ii.     Sky Box Office, Sky Store purchases/rentals, Stand-alone Premium Channels, or pay-per-view services and events all of which if offered via Sky Glass will be chargeable at the current standard price

    20.  Sky Stream puck and the Whole Home subscription will allow you to watch Sky TV on another TV  with a compatible HDMI port.  This is included as part of the Prize.  After 12 months, the Whole Home subscription will be charged at the then standard price unless you cancel it.  The Whole Home subscription is provided on a monthly rolling contract and can be cancelled at anytime on 31 days notice. Cancelling your Whole Home subscription will mean your Sky Stream puck will no longer stream any content.

    21.  Prices, programmes/channels are subject to change. 

    22.  If you do not activate Sky Glass within 14 days of receiving Sky Glass, we will automatically activate it for you and your Sky TV subscriptions will start from activation.

    23.  Winners must redeem the prize within a year. Winners who are in a current pay-TV contract with either Sky or another provider may defer their Prize for a maximum of 12 months from the date of winning.  If a winner does not redeem his/her Prize within 12 months from the date of winning, this could result in loss of the Prize.  If the winner has a previous uncleared debt with Sky the winner will not be able to take up the Prize until this debt has been fully cleared.  

    24.  There is no cash alternative to the Prize or any element thereof and unless agreed otherwise in writing the Prize is non-refundable and non-transferable.

    25.  Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inappropriate, offensive or unlawful.

    26.  Prize winner will own the Sky Glass TV and Sky Stream Puck. Separate Terms and Conditions apply to Sky Glass and Sky TV subscriptions.

    27.  The winner will need to set up a Sky Glass account either online at sky.com or via the MySky app in order to manage their account.  Email address required for account login and for Sky to keep in touch about the service.

    28.  Sky Glass delivery currently average a 40 day waiting period.

    29.  Prize winner has a choice of 5 x Sky Glass colour finishes; Ceramic White, Ocean Blue, Racing Green, Dusky Pink and Anthracite. Prize winner will need to confirm colour preference upon acceptance of the prize.  Colour stock is subject to availability and may result in a longer waiting period.

    30.  Ultra HD and Dolby Atmos pack required to watch Sky content in UHD/HDR and Dolby Atmos.  Not all content available in UHD and/or HDR. Content must be optimised to watch in Dolby Atmos.

    31.  Netflix basic is included as part of the Sky Ultimate TV subscription and allows viewing in one screen in SD.  Netflix terms of use apply.

    32.  55” Sky Glass has an energy efficiency rating of F on a scale of A-G.

    Prize Terms and Conditions G:

    33.  The prize winner and their guest, must be ages 18 or older, and free to travel to London on the 14th September 2023.

    34.  The prize will consist of: Exclusive access to the Sky VIP lounges launch

    35.  When we contact the prize winner to let you know of your win, we will also confirm how you will receive further information about your prize.

    36.  The prize is for personal use of the Sky customer or their nominated recipient.

    37.  The prize does not include: airport transfers in the UK or Republic of Ireland, mini bar charges, service charges or any other service, or form of hospitality or item not described in Clause 37 above.

    38.  Sky may make audio/video recordings at events for promotional and marketing purposes such as promos and video content for broadcast, digital and/ or social platforms. Such recordings may include general “crowd shots” which by entering the promotion, you agree to participate in.

    39.  Sky may also request that you participate in audio and video interviews regarding an event, which you are free to accept or decline. If you accept, a written consent will be obtained at the time of the recording, detailing how your name and any image, video or voice recordings of you may be used by Sky. You agree that the copyright (if any) and all other rights title and interest in and to any contribution by you shall vest in and be irrevocably assigned to Sky.

    40.  You and your guest must keep to:

    41.  all separate terms and conditions on which the prize is issued by the relevant experience organiser (ticketing T&Cs) and if there is any difference between the ticketing T&Cs and these terms and conditions, these will take priority; and

    42.  All applicable laws which apply in the countries in which your experience takes place.

    43.  If the prize or any element of it, is cancelled, changed, postponed or relocated, we may give you a similar prize instead. We will not offer any form of compensation, financial or otherwise. If the prize winner is unable to take up the prize or any element of it because of a failure on the part of the prize winner to comply with the terms of this promotion including, for the avoidance of doubt, compliance with all travel and entry requirements or restrictions, we will not offer an alternative similar prize or offer any form of compensation, financial or otherwise. We also reserve the right to award the original prize to an alternative entrant.

    44.  Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from the enjoyment of the prize; and/or any postponement, cancellation, delay or changes to the prize beyond the Promoter’s control; and for any act or default of any third party supplier.   

    45.  By entering the competition, if you are the winner, you agree that you and your guests (if applicable) agree that Sky may make your full names and counties available and may use your full names, counties and photographs for post-event publicity purposes without your permission or paying you anything.  You further agree and agree to procure that any guests agree to the use of your names, images and any video or voice recordings of you or your guests (if applicable) in any media in, perpetuity, as Sky sees fit.  You agree and agree to procure that your guests agree that the copyright (if any) and all other rights title and interest in and to any contribution by you or your guests shall vest in and be irrevocably assigned to Sky

    46.  Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inappropriate, offensive or unlawful.

    47.  By entering this promotion and choosing to opt-in to receive more information, you agree that Sky may use your information to contact you about offers, news products and services you may like. You can change your direct marketing preferences by contacting Sky on 08442 41 41 41. You can also click on the “unsubscribe” link in direct marketing emails from Sky.

    48.  Any entrant data collected will be used for the purpose of administering the promotion and contacting the winners to notify them of the prize and, if you are the winner, we may pass them on to third parties to deliver the prize.

    Prize Terms and Conditions H:

    49.  We will endeavour to transfer the prize money to your bank account within 28 days but are not responsible for any delays. You must provide all necessary details via the method directed within 14 days after the original request to do so otherwise the prize will be forfeited at our discretion.

    Data Protection:

    50.  Your personal data that you provide to us will be collected and processed by us, our licensees (including Communicorp UK Limited), the Promotion Partner as well as the Prize Providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes.  

    51.  By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy which sets out full details of how we process personal data and how you can exercise your rights as a data subject, and our Promotion Partner’s Privacy Policy. Please ensure you have read and understood our Privacy Policy and our Promotion Partner’s Privacy Policy before entering any Promotion. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us and our Promotion Partner with their personal data.  

    52.  You may be asked if you want to opt-in to marketing from us and/or our Promotion Partner when you enter a Promotion. If you choose to opt-in, we and/or our Promotion Partner will use your personal data for marketing purposes (see Global's  Privacy Policy and our Promotion Partner’s Privacy Policy for more details). You can withdraw your consent to marketing at any time by unsubscribing.   

    53.  We, our Promotion Partner and the Prize Providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. Where any transfers are made outside of the EEA or UK we and the Promotion Partner will ensure appropriate safeguards to protect your personal data are in place.   

    54.  We will hold your personal data for a period of up to 3 years in order to comply with our regulatory obligations.   

    55.  You may request the removal of your personal details from our database by contacting privacy@global.com. If you request that your personal details be removed prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
