Litigation claim for unpaid recovery invoice

Hi all,

Have just received an email stating litigation action has started following an unpaid invoice from 2018.
The invoice was from Ingram Toft, regarding a compensation claim from Wonga. However I did not receive a payout due to wonga being in administration and have a number of emails from Ingram Toft up to 2020 regarding the administrator action and claim handling but nothing regarding an invoice.
Where do I stand with the matter, as I was under the impression it was 'no win no fee' and as I never received a payout, I can't give them a percentage of said non existent payout.

This came as quite a shock as its been a significant time since dealing with them, and is the first contact in 3 years!

Regards,

Sam.

  • I got one today! I didn't owe them anything, infact, I got stitched out of 30K+ refund because "they run out of money".
I've rang the number but no body answers?!
I'm not clicking a link, is this a legitimate email???
  • I reckon they've cocked up and auto sent a load of non demandable invoices. I've replied asking them for proof I've received a payout to the value stated, as well as copies of all correspondence and documents relating to said invoice, but have yet to get a reply.
  • Hope so, its very aggressive:

We are writing to you with further regard to your unpaid debt. We have previously communicated by email/ phone call/ letter to remind you about the unsettled balance.

We take this opportunity to inform you that despite our efforts at an amicable settlement, there is still an outstanding amount due. In light of this, we regret to inform you that if the payment is not received within a week, we will have no other option than to contact DCBL debt collectors. This will result in additional costs being added to your account.

We understand that you may be experiencing financial challenges. If this is the case, we encourage you to contact us immediately to discuss possible payment options that may be available to you. We are willing to enter into a Payment Plan to assist you in making smaller, manageable payments.

If you cannot afford to make payment in full, we suggest a minimum payment of 20% of the outstanding debt to be made straightaway. This gesture will demonstrate your willingness to clear the balance and help avoid being escalated to debt collectors.

Please be aware that we are serious about the collection of this debt and will not hesitate to escalate the matter further. Please do not ignore this letter as this can result in further consequences that may affect your credit rating.

We hope to resolve this matter as soon as possible and appreciate your prompt attention to this matter.

  • I'm tempted to contact action fraud, having spoken to a few people, they reckon someone in the business is trying it on.
I guess you were in a similar situation the?
  • Yeah, I didn't get a penny. Back then I was tied up with them, but then when the Vatican dropped out, I got lucky and cleared my debt with WONGA and when they calculated my refund it was 36K! I was elated obviously butthen after months of waiting,  they announced that the money was gone. I'd have purchased my house with thar (sad time).

  • Found there Ts&Cs that clearly state, if no financial benefit is received, you pay us nothing (section 4).
Just waiting for a reply now!
  • @samuelsphelps, you had any joy yet?
