Court Defence vs UKPC/DCBL - Parked in allocated resident slot

    5      The defendant possesses a resident parking permit, which has been issued by UKPC since the 27th of June, 2019. Following the loss of the original permit, a replacement was promptly provided. Remarkably, during the period encompassing the replacement issuance, the Claimant proceeded to issue the Defendant seven Parking Charge Notices (PCNs), despite being well-informed of the replacement.

    This is close to fraud by UKPC supported by DCBL.   They knew you applied for a new permit and whilst WAITING they knowingly attempted to extort money from you.
    A JUDGE WILL LOVE THIS ONE

    "The Defendant alleges that they were awaiting a new permit being delivered in order to park onthe Land. During this period, the Defendant continued to park on the Land in direct breach ofits Terms by failing to display a valid permit. If the Defendant was unable to comply with theTerms, they could have sought alternative parking until a valid permit was received/obtained."

    Who wrote the above rubbish ? Guess it was DCBL
    You are not alleging, you are a telling a fact and during the period when you applied until you received the permit, UKPC ACTED UNREASONABLY and issued multiple charges

    The mind boggles at the state of mind by DCBL attempting to extort money and no doubt adding their own fake.

    Many better legals than DCBL have been spanked in court over residentilal cases

    If this was me, I would go to court because it is yet another rubbish UKPC/DCBL case
    which is unreasonable with no merit and claim your costs

    The paragraph you quoted was indeed from DCB Legal's Witness Statement, in response to my statement made in Defence.

    Actually, DCBL wrote this kind of response to each point I made in Defence.

    So I think I might just state my dispute as I wrote in 6.5 - 6.11. 

    Any advice would be more than welcome.

    Yup, I missed that. The OP went straight from a "wish to claim" from DCBL (Limited or Legal) straight to WS from DCBL(?) or the claimant? to hearing date.

    It may be worth knowing what was actually stated in the defence and how it was submitted.

    I am very sorry but I found this forum too late.

    I drafted my Defence and submitted it through the Moneyclaim website. I also sent another sort of questionnaire form to the court by email. I have posted my defence in my reply to Mad Coupon above.

    Then several days later I received the court being assigned to Clerkenwell and Shoreditch. Then a hearing date was assigned. The letter also asked me to provide Witness Statement and all related evidence.

    DCB Legal send me their WS via email. I need to do the same by 4 pm next Monday. 

    Actually the over-long Defence I posted is my Witness Statement.

    Any suggestions would be very much appreciated.

    That would be the DQ - N180 form.

    Just done the court hearing today, surprisingly BCBL indeed sent a solicitor. 

    The judge actually not so impressed by the claim made by UKPC and encouraged me to say I was not in a contractual relationship with UKPC. 

    Case dismissed! Also I will be able to claim the cost of travelling to the court as witness. 

    What a journey

  • Well done. Another spanking in court for DCB Legal and UKPC.

    They should have discontinued as the usually do following a defence using the forum defence template.

    Whilst it is a win for you, you could also probably had this thrown out anyway as there is now a pervasive appeal judgment you could have used too.

    Which Judge & Court? 

    Do you mean the Judge helped you along to make the point that the signage was inadequate, and that's what won it?

    Was their solicitor useless and unprepared, or did they try hard but the Judge was with you?
