Moving from LCW to LCWRA

Hi,

I've been on LCW since 2021 but I didn't receive any extra payments, I have been moved to LCWRA and will receive the extra amount. My question is - will I get the 4 months since I asked to be reassessed backdated, as I was already on LCW and just being moved over to LCWRA I'm under the impression that there is no 3 months I waiting period. Do I have this right?

    Yes no waiting period. Ask them what date the LCWRA has been applied from and if you owed any underpayment of benefit backdated to when you provided evidence to support reassessment process.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

  • Sorry if this is the wrong place, new to the forum. Hoping I can get some help.

    I have recently gone from LCW to LCWRA activity but my back payment was only until I restarted sending sick notes. I was previously told after my LCW that I didn't need to provide sick notes. I have been classed as LCW since 2021 and was only able to get a health assessment this year. I have continuous sick notes back in 2021 but they stopped after the LCW said I didn't need to. Am I completely misunderstanding or should my claim be backdated to my sicknote/LCW award notice?

    That sounds that you were awarded LCW in 2021 following a paper based or telephone assessment.
    You were then LCW until a reassessment was held and you were awarded LCWRA at that reassessment.
    In which case the payment for LCWRA element should start at the date of the new decision that you are now LCWRA.
    To put it another way- the LCW decision was made on one date back in 2021, and lasted until the new LCWRA decision was made on a new date, so you can only be paid LCWRA from that new date. (Before that date you were LCW and that hasn't changed).
    The new decision doesn't change the old decision, instead it replaces the old decision starting from a new date.

    How can the fit notes be continuous when they stopped after you were found to have LCW? If this was a review started by DWP then it will be from the assessment period in which the decision was made. You will only be owed extra money from an earlier date if you reported changes to your health condition, which prompted a new assessment. You would have then needed to provide fit notes.

    The reason it took so long to get LCWRA was that I was told wrong information. I only got LCWRA as I saw someone different and they fast-tracked the process. I didn't get a reassessment despite asking for one several times.

    I started my claim with a sick note as I was unable to work at the time I started my claim. I did add changes when it got worse but I was never asked to do an assessment. I continued sending fit notes until I got the LCW where it stated I didn't need them. At the time I was told I had to wait to be considered for LCWRA but they never let me do one until this year. I told them in my journal about my health and despite being too ill to work never found out about the UC50 until this year when I was forced to have an in-person meeting and spoke to someone different and they sorted it for me (I hadn't had an appointment for over a year before this). Despite them knowing about my health I was never able to get moved to LCWRA until this year. I have patchy sick notes as I find asking for them very stressful. I asked my doctor if they could make a new backdated one to cover any gaps in these dates. 
  • Further information -After getting LCW  I didn't have to search for work or communicate at all with UC. I didn't have regular appointments.
  • I don't know if it makes a difference but I have been getting PIP since 30 Jun 2022 after a long wait to be assessed.
  • Between when my claim started in 2021 and 2023 I have several health updates/journal messages about my health but no one told me about LCWRA until I got a random appointment this year.
