Hello, newbie and techno numpty to boot so please be gentle with me 
I got a PPC from Total Parking Solutions (am I right in thinking this is the same as the notice to keeper?) and just want to know if I'm on the right track or if I've missed something after reading the threads and stuff - there's a lot!.
Anyways it came through the post on Monday 14/08/23 for an overstay at retail park in Crewe - the 'contravention' was on the 18/07/23.The date of notice is 31/07/23. So its arrived the day after that 14day reduced charge/bribe deadline. The PNC shows the car going in and out but nothing else. There's what looks like a sign on entering but its the back of it so doesn't show any details. I genuinely can't remember seeing the signs but I'm told its 2hr free parking. I'll know for sure tomorrow and if that's the case, the overstay is for 28minutes. This is what I've done so far
1. Emailed the retailer to make a complaint & had a reply today- sympathetic but basically saying that I need to appeal/challenge and on getting the response they would get involved, can't guarantee it'll be cancelled but they would try.
2. I'm going back to the retail park tomorrow to check out the signage and will take some pic's - there's also nothing on the PPC to show any signage or how long the overstay is supposed to be. Should there be as from reading threads i got the impression they needed to show them?
3. I then complete the 1st appeal letter - if I upload that on completion, will someone cast eyes over it to make sure I've revealed info I shouldn't have?
4. I've got 28days from the date of issue (31/07/23) to put in the appeal.
I'm disappointed Dunelm didn't knock it on the head. My initial feeling was just to ignore it like I did 4yrs ago, but guess things might have changed? If I've got to respond, I want to make sure I'm doing it right and any advice will be most welcome!

Hello and welcome.
You would be wise to appeal.
You need to point out that their Notice to Keeper arrived too late to hold the keeper liable for anything that the driver may have done.
In greater detail... the NtK is dated 31st July so, allowing two days for it to get to you, the earliest that you could have received it was Wednesday 2nd August. That is over fourteen days from Tuesday 18th July - the date of the parking event.
Do not give away the driver's identity. That includes on this forum. Your opening post comes close to doing that.3 -
Just to be clear for the OP, you appeal to TPS as the RK. You remind them that their NtK was sent too late to arrive within the compliance requirements of PoFA 2012. As the driver is the only person who can be held liable and there is no legal requirement for the RK to disclose the driver's details, you will not be doing so and therefore your involvement with this issue is now complete. They should take this matter up with the driver.0
