    The Template Defence does challenge the Claimant's standing to sue, so your Judge picked up on that and ran with it!

    You really were risking an added £200 or so in costs though, as well as losing the case (possibly) if they had turned up.   If ever you know you can't attend a hearing you just excuse yourself not less than 2 weeks before.
     Not just be a no-show.  That's unreasonable conduct.

    However you got VERY lucky!

    And we got a great 'transcript' effectively!

  • This is great news as I’m in court on the 29th of this month and will be using the same defence. Gladstones have already said they aren’t turning up and have actually supplied some evidence that supports my defence as well as omitting things which I think the judge will take a dim view of.

    I had no intention of claiming anything back , but now I think I should ask for time lost. What’s the deal with the unreasonable behaviour costs?

    You ARE going to file & serve a WS that attaches the Judge's decision in this case?  Have you done your WS bundle yet?
