Fever said:I have received NPM / Gladstones Witness Statement and, included as one of their exhibits is the Parking Scheme Agreement between themselves and the property management company of the flats
remember though that I parked on the road outside the car park to the flats.
I contacted the CEO of the management company and she said1 -
Yes here's their site map, the the 'parking boundary' helpfully marked - a boundary which I was parked outside of - approximately where the dark coloured car in on the right, on the road
Also they point out all the signage in the car park with stars but... that clearly seems like it's signage FOR the carpark, not the road, right? (all the signs just say 'this site' which is ambiguous)2 -
Just getting back to let you know that the hearing was on the 13th, their lawyers had already emailed to let us know that they weren't turning up so it was always going to be dismissed
I couldn't believe, after everything I'd looked into and all the holes I'd found in their case, like having the 'land owner' on record stating they they didn't own that particular piece of land etc. that the judge threw it out on the grounds that it wasn't even a valid PCN because it only had a time of parking, not a duration of park or time of leaving so no evaluation of consideration time or grace period could be made! Not sure how I missed that one!
Anyway, REALLY glad all this is finally over, just wanted to say a big thank-you to everyone on the forum who either replied to this thread or but the invaluable resources on there in the first place, or both, especially Coupon_Mad who was a great help5 -
Yay well done! Did you ask for your costs?
