Pay & Display Machine Location; Defence Against Issuing of a PCN?
Parked in a street the other day, sign said "pay by phone or machine". Phone wasn't an option so machine it was...
As far as I could see, no pay & display machine could be found on either side of the 200m-long stretch of road. (I had a good look.) When I got back to my car a while later, was greeted with a PCN (fun times).
When I got home, looked up locations of machines in the area on local council site and found it 120 yards away from where I was parked on the other side of a local main thoroughfare in what I thought was a separate street altogether! I contested the PCN on the above grounds, council said the PCN was correctly issued because parking officers wait 5mins at the car's location before issuing a ticket and you have the option to pay by phone anyway (didn't have that option, as mentioned earlier).
Is there a valid defence that can be made here?
