Hi,
Bit of a long one so here we go!!
I have just recently recieved an enforcement letter from a debt collectors about a clean air charge in 2022 in a city miles away from where I live.
Apparently this has been to court already. I moved in 2020, and changed my address with the DVLA for my licence and car, but not the car that was stolen years before. Apparently the insurance company didn't tell them that they had paid out the settlement. Any correspondence concerning this went to my previous address until this week.
The car they are chasing me for was stolen in2014. The DVLA have it as stolen and the police have a marker on it. I checked. I also asked how a stolen car was driving round a major city without being stopped!!
The debt collectors advised me to go onto the council's website and 'view the evidence against me'. The car in the photo wasn't my stolen car. It wasn't the same colour, model and even the numberplate was different. The Apr camera had read a G not a C.
I explained this to the debt collection agency and they confirmed that it was in fact a different car, but as it had been to court, there was nothing they could do.
I went to the council who issued the charge who said yes it is a different car, but there is nothing they could do.
I was told to apply to the issuing court to apply for an opportunity to send a late statement as to why I never replied in the first place, but there was no guarantee and the conviction would stand.
How do I end up with a judgement against me for a car that wasn't even mine?
I've tried some solicitors but it's not something they deal with.
Any help, or solicitor recommends would be gratefully recieved...

Make a complaint to the Local Authorities Ombudsman. It's free and they can award compensation and order Councils to take action to remedy any detriment. Let them tell the Council to sort this!
You have to exhaust the Council's own complaints policy first so it may need one more final complaint warning them that's what you are going to do.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
