    From what I understand the Section 20 legislation seems utterly pointless, as the landlord can simply neglect to consult and then subsequently request dispensation from doing so "for some reason" 😂  Which is then granted, without any recourse to informing the tenant why.  I've asked for a copy of the form submitted to the First Tier Tribunal but seems futile.

    It might be more useful to look at the Tribunal's decision. You might be able to find it here:   https://www.gov.uk/residential-property-tribunal-decisions


    But more generally, taking a step back, you're clearly very annoyed with the HA, but...
    • What is your goal?
    • What is it that you'd like to happen?
    • Or what is that you're worried will happen, and you want to avoid it happening?

    For example, it seems you're trying to prove you didn't get 3 letters. Why?
    • Is it because you want an apology from the HA for not sending the letters?
    • Is it because you want compensation from the HA for not sending the letters?
    • Or will you be better off in some way, if you can prove the HA didn't send the letters?

    It's probably best to focus on the outcome you're looking for, rather than focussing on annoying things that have happened along the way.

    Thanks Eddy.  I think what I'm trying to establish is the basis for a relationship with the HA that is fair and just. I am concerned that from the very outset they have demonstrated contempt and disregard for due process and this does not bode well for the future.

    I am fulfilling all of my obligations as tenant/leaseholder yet they have, already in such a short space of time, ridden roughshod over their duties as landlord. So I guess I would like some recognition of that,, for them to be held accountable, some form of compensation for the ongoing financial detriment being caused, but more pertinently I'd like them to do as they're obliged to do in consulting me, informing me, and when they do carry out work, do it to a standard that I am satisfied with.

    I find it utterly preposterous that they have commenced work on my property without notifying me, have caused damage in the course of carrying out their works - twice - and have taken an unsatisfactory amount of time to acknowledge and repair the damage they've caused. All of this is happening before I've even moved into the property and their appalling service is preventing me from doing so (a myriad of logistical reasons mean I cannot move in until they have completed their repairs).
  • Quick question all - I've had a text message from the HA to confirm repairs to damage their contractor caused have been booked in for the second week in October.  I cannot wait that long for them to repair the damage, so am I able to source my own contractor and ask them to invoice the HA? How do I go about doing it? And is 8 weeks from being notified of damage to repairing it an acceptable service level?

    Quite standard for routine repairs - some places promise them in 28 days whilst others may have a 60 or 90 day promise. The damage doesn't stop you living there from what you have said so why can't it wait that long?

    Read their website and see what they say they do and in what timescale.

    Source your own and they are unlikely to pay for it

    Has anybody else experienced similar issues and if so, how were they resolved?
    I own a leasehold flat in London also with a large HA as freeholder and managing it.
    the service level is shocking.
    the organization is beyond incompetent. they renewed our entire roof approx 1 year after me moving in without the proper consultation and budgeting process. I documented everything well and sent regular emails chasing and reminding them.

    so all i am saying, your situation doesnt seem aytpical. large HA seem utterly understaffed and inundated, communication is super poor. 

    I think most important to document communication as best as you can in case it ever comes to a legal dispute


    Hi, can I ask how much you were invoiced for the new roof?

    I have received an invoice today for 'roof replacement and associated works' (soffits, fascias, gutters) totaling c£8,000 which is a lot more than I'd anticipated.  I believe my flat covers an area totaling 94.9 square metres though the invoice summary lists new roof tiles @ 48.3sqm; I had been led to believe from word of mouth that works would probably cost around £5k.  Moreover, this would seem to indicate I am being invoiced for the full amount, whereas I'd anticipated sharing the cost with (at the very least) the tenant in the downstairs flat.  Is it true that if I own the leasehold on my property and the tenant downstairs only rents hers I have to pay the entire bill for repairs to the building etc.?
