APCOA station parking

Hi - in a similar situation to many with APCOA. 

My car was parked in a railway station carpark back on 8/9th July overnight.  My partner paid for the parking using the app and saw the confirmation, but one month later I have a copy parking charge notice on my desk, so this must be due to the app failing to work. 

Only difference here is that it's a company car so I only have the copy sent to the leasing company so far.  Leasing company have given my name to APCOA on 1st August as nominated person with use of the vehicle.  This does not mean I was the driver, of course.

So I'm currently waiting for the notice to be reissued to me before starting the process of sending the 'blue text' in my appeal.  I guess there is no point in mentioning that this is caused by an app failure.

    When you receive the Notice to Hirer, please come back and confirm to us whether it shows as a Parking Charge Notice or a Penalty Charge?  How you deal with it will be a little different, depending on which. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Please read the Newbies/FAQ thread which deals with PCNs as NtH (* COMPANY, LEASE OR HIRE CARS ANYWHERE IN THE UK). There is very specific instruction on how to deal with an NtH which is what you will receive from APCOA.
  • It is a Parking Charge Notice.    It doesn't appear to say notice to hirer anywhere on it - it is addressed to the company I work for, saying notice given to the registered keeper of the vehicle..  Day 28 today so I'm reading back through the newbie thread before submitting my online appeal

    But you can't appeal as it is not in your name. The lease company must inform APCOA and transfer liability to the hirer. When they have done that, APCOA must reissue the PCN as a NtH in your name.

    Have a re-read of the newbies/FAQ thread and look for the section on lease/hire vehicles and you will use on of the Edna Basher appeals.

    I hope the company did appeal?

    Not that it matters.  It times out after 6 months. They should ignore APCOA if they failed to appeal in time.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
