Buying with Credit

I Bought a lawn mower on line using "Newpay" Credit, the company I purchased from ( DTW Tools & Machinery ) couldn't deliver so I canceled the order,now they refuse to give me my money back or to cancel the order with the credit company. I informed "Newpay" Credit that I'd cancelled the order and that the company I had delt with was unable to deliver. they informed me that it was sad - but they can't do a thing about it, and I still have to pay the £560.53 despite their credit agreement saying - " If you purchase any item of goods or any services costing between £100 and £30,000 under this Agreement you may have a right to claim against us as well as the supplier if, for example, the goods fail to arrive or are not of satisfactory quality or the supplier made a representation which you relied on about the goods which was not accurate." Now I'm left trying to get Their Money (Newpay) from a company that doesn't respond, they can't tell me if they have repaid Newpay Credit because of "Data Protection" so all I'm left with is to pay- Oh! and of course if Newpay Credit are reimbursed they are under no compulsion to inform me,

Open a formal complaint with Newpay. They are regulated by the FCA, and if youre not satisfied with their response, you can go to the financial ombudsman.If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -
I have made a complaint but I don't hold out any hope, funny the complaint is based on their own terms and conditions as mentioned above, Having now read the one star reviews on Trust Pilot for DTW Tools & Machinery, Standish. one can see that this is not a one off thing for them, they constantly refuse to pay back money, yet Newpay (who must be aware of this) still allow them to use their credit facility, one would be forgiven if one thought that they were both in this together they certainly never paid "Due Diligence" to the company they allow people to get into debt over.I'm 72 years old and disabled and just the thought of going to the financial ombudsman fills me with dread. I may have to resign my self to NOT having a Lawn Mower, and being £ 620.53 out of pocket (I also bought a battery charger for £65.00 which I paid via my Debit Card).

The debit card payment you can do a chargeback on.
What were the payment terms on Newpay? Not all credit agreements are regulated by the CCA, hence we have seen the explosion in lenders offering 3 payments over a period of less than 12 months as this then isnt a regulated loan and so no S75 (and a bunch of other things).
Why couldn't the company deliver? What is their proposed solution?0 -
I set up an 18 month plan with Newpay @ £35.42 a month, their a big company, I believe they finance the John Lewis's Store card. - It was the fact that DTW Tools & Machinery did credit that persuaded me to buy from them, not because I wanted or needed the credit, but because I thought that a company that offers credit would have been vetted in some way by the Credit Provider (How wrong I was) so I felt safer. I had no intentions of paying £35.42 a month for the next 18 months, my plan was to Pay it all off when the first payment is due, namely this Friday the 11th Aug.Credit is provided by NewDay Ltd, a company registered in England and Wales with registered number 7297722, registered office: 7 Handyside Street, London, N1C 4DA. NewDay Ltd is authorised and regulated by the Financial Conduct Authority with number 690292 and is also authorised by the Financial Conduct Authority under the Payment Services Regulations 2017 (Ref no: 555318) for the provision of payment services.Newpay & Newday are the same company.Hope this helps!

What happens if I need to return an item?
If you return a product you have bought using Newpay the refund will be applied to your Newpay account. If any interest has built up, this will still be due. If you had an instalment plan, the monthly payments will still be collected until the interest is repaid.

sheramber - That's all very well when the Supplier plays ball and informs Newpay that the good have been returned or as in my case canceled. In this case they are keeping Quiet and pocketing the money, Newpay will not take just my word for it, but they will not contact the company either?What seems to be happening in this, and the other cases of non payment is DTW Tools & Machinery are selling Items they don't have, they are hoping to have the goods paid for before ordering from their supplier this can lead to extended delivery problems and cancellations. I know my Item is in short supply (or was) Stihl (RMA 448vc cordless lawn mower)I have an e/mail with the T & Cs which I've copied into a notepad Doc. but what can I do with it now? - I can get a copy of it, but I think one would have to be logged in to read it. My initial Post has an Intresting Quote straight from the T & Cs ( In Quotqtion marks)Thanks everyone.

Hold the front PageHaving sold my heavy petrol Lawn mower I desperately needed this Battery Mower, so having canceled the one, I bought a second from a different source, This was delivered Yesterday having been stuck in the Parcel Force depot for three weeks. Low and behold 5 minutes ago DTW Tools & Machinerys Lawn mower turns up having been stuck in the same place for Four weeks - I had to send it back of course but it seems " Parcel Force " are the bad boys here. Lets see if I get my money back once they recieve it.Sorry to mess everyone about, I did cancel it but not soon enough it seems. I've phoned DTW Tools & Machinery and made my Apologies, not really good enough I know but it's all I can do.Sorry everybody.
