Send APCOA this - let's see how they respond.

    Dear APCOA

Unequivocally, the Penalty Notice will remain unpaid, therefore please serve private criminal prosecution proceedings without delay so your entitlement to do so can be tested. Please confirm that you are the Train Operating Company.

    Yours sincerely

There's nothing to fear in that. APCOA cannot initiate a prosecution. Only the the TOC, can initiate the prosecution. APCOA is not going to waste more than postage on this because they know that they have nothing whatsoever to gain.

OP, just follow the advice and string everything out. It will wither on the vine.

Better at Poker ...... and almost unbeatable at Snap (ask my grandkids! 😩). 😄
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Apologies guys!
Thanks to the person with sharp eyes who noticed the different dates.

It is indeed an NTO for my partner.. who did exactly the same thing, paid for a day and got stung because of the small print. Great.

When I inevitably get a letter from some barrel scraping solicitor firm or debt collector with lots of threating sounding language and large fonts - How do we go about tying them up until the 6 month period? Or do we just ignore it basically until the magic day.

APCOA only use debt crawlers like ZZPS or DR Plus.  No solicitors. Even if they did, NOTHING could happen because a byelaws Penalty can't be pursued under civil contract law.

    At all. Ever.

    One favour please:

Whilst your case is quiet, please could you help us with OTHER car park evidence that I need in August & September, to take to the Government?

    https://forums.moneysavingexpert.com/discussion/6463361/dluhc-private-parking-code-government-launches-call-for-evidence-discussion-thread#latest

Please please add photos as seen there!  Think of this call for evidence when strolling around your town and you spot car parks at churches, shops & businesses that are unrestricted yet there is no abuse, no 'carmageddon'!

OR supermarkets with £70 PCNs only.

OR hospitals with £50 or £60 to deter abuse.

All I need is photos and location.

    I will do the rest.

I can PROMISE this evidence will be seen by the decision-makers because I'm on the Code of Practice Government Steering Group representing motorists, and the DLUHC will read my submissions.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
