  • So, finally got the court date through. It'll be in June. Also got a Save as to costs letter through from CE Ltd offering to settle for £95 rather than the claimed ~£300. So three questions for the experts if I may:

    1. Is the letter from CE Ltd standard practice or does it signify a lack of confidence in the strength of their case, and is there any way disregarding this "offer" could harm me in court if I lost?

    2. Is there any point me responding to the letter in any way, if I'm not going to accept the offer? 

    3. Is there any advice on how I should prep for my day in court?

    Ignore it, standard and can't bite you.

    Hearing tips are in the NEWBIES thread, right underneath all the main info you obviously need to comply with your deadline and WS obligations on that Hearing Order.

    You don't just rock up relying on a bare defence.

    The hearing order gives me until early April to get my ducks in a row, so I'll start gettingthat together now. It states that the claimant must provide me with a copy of the agreement that authorises them to regulate parking on the land in question by mid March.

    Is that also standard procedure? I'm sure I read something a while ago where parking companies are so disorganised that they sometimes fail to produce this evidence. If they don't get that to me by the date specified would the judge likely rule against them.

    It's good that the court has ordered them to do their thing first. Is this Southampton court?

  • In news that I'm sure will shock everyone, CE Ltd have failed to provide me with any documentation (including a copy of any agreement that authorises them to regulate parking). They were ordered to do so by 4pm on the 18 March.

    Does that mean the judge will likely refuse to hear their argument?
