Leased Car - UK CPM fine - Lost IAS appeal (of course) - Do I just pay to avoid Lessor Admin fees?

I have read the newbie threads, etc - however I only came across this forum far too late after starting the appealing to IAS etc.

I received a total of FOUR fines (different dates within the same 3 week period) for parking in Loading Bay in a residential complex in the late evening for approx. 1.5 hrs each time.
Oaklands Rise, Old Oak Common, London.

I appealed two- lost the appeal, and forgot to the appeal the other two.
As I lease my vehicle from RCI (Nissan);  for the two PCN's that I did not appeal, RCI (the lessor) were sent payment escalation fines, and wihout notifying me, paid the fines £100 each, and have charged me the same, plus an admin fee of £12 for each.

I then appealed (via the IAS) the two PCN's that were rejected by UK Car Park Management Ltd - purely to buy me time, as I did not want to have to be in the situaiton where the lessor was paying the fines and charging me an additional admin fee.

I have attached images of the poor images captured below. The poor images was the basis of my appeal to IAS - of course they did not care.

Given that I am a lessee it seems I cant just ignore. The lessor (RCI) are far too happy to oblige and just automatically take payment from me.

I have told the lessor I am appealing and to not pay this whilst I am appealing this - however this did not work in the past. Theres no incentive for them to ignore these fines. They have previously responded with the following:
"We did originally request the issuing authority (UK CPM) to transfer liability of this fine to yourself. However, they wrote to us 23/05/23 escalating the fine and as we are registered keeper of the vehicle and liable for any escalated charges, we did make payment on your behalf."

Quesiton: Any thoughts on how to best (keep) challenging this?

I think ( though I could be wrong ) that RCI cannot pay private parking charges on your behalf - if you check your contract you will find it probably mentions something about "fines" ( for say speeding or yellow box or even council parking ) - but these are invoices. You should be asking RCI why they have paid invoices on your behalf which you know are not payable.

I don't think RCI have done anything wrong.
All they are doing is protecting themselves.

The only contact a parking company has is the vehicle's Registered Keeper.
UKCPM wrote to RCI and RCI gave your details to UKCPM as the 'day to day keeper' of the vehicle.

For two of the PCNs, you responded to RCI and liability for those PCNs was transferred to you. RCI no longer had any liability.

For the two PCNs that you forgot to respond to, as far as UKCPM were concerned RCI had failed to transfer liability to you. UKCPM had two options - 1) continue to chase the Registered Keeper, RCI, or 2) forget about those two PCNs. It's not difficult work out which one they chose and why.

When faced with that, RCI decided to pay what UKCPM were asking and recover that outlay from you.
    Looks reasonable to me.

You big mistake was forgetting to respond to two of the Notices to Hirer.

Unless these were all windscreen PCNs?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks for comments so far.

To clarify a couple of point:
@Coupon-mad these were not windscreen PCN's
@KeithP I agree. But just to clarify, for the Two that I have appealed via IAS - and lost - I am certain UKCPM will chase RCI for payment not me - as its a sure way of getting paid with no delay.

There doesnt seem to be a way to keep appealing - so I guess I just have to accept and pay, even though I think that fining someone using such low quality image ievidence is dubious.

    No that won't happen.

As I said earlier, and @Grizebeck confirms, "...liability for those PCNs was transferred to you. RCI no longer had any liability.".
  • This is helpful, thanks both @Grizebeck and @KeithP .

Does anyone have any experience with UK Car Park Management Ltd?
    Better to ignore, or otherwise?
  • sorry Ignore my question.
I can see that the advice is to seek advice if I get a letter from county court.

Why not just search the forum for UKCPM and change 'best match' to newest' results?  Reading other cases is the best preparation and you can bookmark good ones to read again later.
