AIRBNB - Gladstone PCN

Hello,

I stayed at a Airbnb that provided parking (via a secure gate that required a fob).

UK Car Park Management Ltd sent me a fine as apparently I was parked without permission. 

I have tried to dispute this via Airbnb / request that they pay the fine but no luck so far. I tried to appeal via the appeals process but to no avail (reading your NEWBIES thread I can see why now!)

Gladstones appear to be representing now. I’ve only just started reading up and I’m a little worried if I’ve missed a letter I should have replied to. 

I’ve received a “Letter before Claim” 22 May but I’m not actually sure if it’s legit. There were no Reply Forms attached, merely a slip to reply for paper copies. I haven’t received any official court papers so don’t think I can acknowledge service as I don’t have a claim reference number. I signed up to the only service but have stalled at the claim reference and defence password stage as I don’t have this.  

I’ve received a letter dated 3 July (delayed post!!) further to our Letter before Claim” which says the PAP has expired. They advised 14 days to respond which will have expired also.

Please can you advise on what I need to do now?

    If you haven't received a County Court claim form from the Northampton CCBC, you're still at LBC stage (although some time has passed - a bit unusual). You could just respond to the LBC now, following the advice in the NEWBIES FAQ Announcement, second post, and ask for a 30-day hold on proceedings to enable you to receive debt advice (use those words). 

    A LBC from Gladstones will be legit. They don't by default send the usual attached forms, rather offering the option to view online or request paper copies. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I’ve just sent a SAR direct to the management company and I’ve emailed Gladstones for a hold on proceedings as per your advice.

    I haven’t received a claim form from Northampton CCBC - I assume this would come via post?

    What do you mean by "parked without permission". What does the parking charge from UKCPM say exactly. Was a permit expected, or what? Whose permission were you meant to obtain (bet it doesn't say).

    Make sure you take a screenshot/copy of the AirBnB listing and any other relevant text, e.g. the details you get sent once you've booked, as they relate to the parking arrangements. This is effectively your contract with the host. If it shows your right to park, then you have permission (though UKCPM will likely disagree).

    Is there a dispute escalation process within AirBnB if you don't get anywhere with the host? Though somehow I doubt they'll want to get involved in something like this.

    Why not just search the forum for Gladstones LBC and change the search to show 'NEWEST' (not best match)?  Loads and loads of recent examples of robust responses.
